Extension for Dependant Child of Tier 2 Minister of Religion

Hello there,

Question : Can a dependant child (Dependant of Tier 2 Religion Visa) who is currently living in the UK (15 year old) apply on her own for leave to remain in UK ( Further extension of 2 years ) after completion of the initial 3 years grant over ?

Background : Family came from India on a Tier 2 Minister of religion visa on 2017 June. Since 2017 both of their children's started their studies in local schools. However on completion of their initial 3 year period they must go back to India. However they wish to extend the visa of one of their child who is currently studying on year 10 so that the she will be able to complete her GCSE in UK. If she can't extend the visa and go back to India then she will lose her 2 years of studies as according to Indian education law she is not allowed to join straight in year 10 instead she should join in year 9 only.

So is there any provision in which we can apply to extend child's visa on its own in UK for further 2 more years under Tier 2 or any other route for the purpose of completing her studies ?

No. A PBS Dependent cannot extend their PBS Dependent visa independently of the main Tier 2 visa holder. All have to apply or all have to leave the UK.

You could look at the tier 4 child visa, but the child must be sponsored by a private/independent school. The child can't go to a state school.
