Tier 1 Application Refused

Post by engrashok » Thu Jul 04, 2019 3:42 am

Hi Team;
My Tier 1 application has been refused. Below is summary of the refusal letter

- application awarded 95 points
- Discrepancy in investement breakdown mentioned during interview vs Business plan
- Used a part of investment (although small) for your own payroll
- Discrepancy in staffing plan, during interview
- Discrepancy in total investment, during interview

I donot agree with above points as, even if some points may not have been explained fully in interview, the officier made the decision based on his assumptions.

Kindly advice on how to proceed? Also how to request the interview transcript.

Also advice if AR/JR is of any worth? and can i do it by myself (especialy the AR).

Thanks

Best,

Please clarify the discrepancies in figures, were they huge differences?

Best,
Is it Initial application or extension??

I’m on a similar boat at yours

AR is a best solution to start with but I recommend to take a legal expert advice

Tier 1 Application Refused

Post by engrashok » Tue Jul 09, 2019 2:35 pm

Hi All;

In the conclusion of refusal letter, I noticed that my application was rejected on grounds of two immigration rules 245B (f) & (h).

However while browsing through https://www.gov.uk/guidance/immigration ... sed-system, I noticed that these clauses have been deleted (not sure when).

Please advice if anyone of you have encountered this and how did you challenge this?

Also advice on how to request the transcript of interview.

Thanks
regards

HI Engr

I was also refused on the same reasons, they have refused under probablities.

if you been awarded the full 95 points and if you beleive that your case was not handed fairly, you can go for Administrative review

Dont give up, as long as all details are intact, go for AR

In conclusion, I am not satisfied that you genuinely intend to invest at least GBP 200K into your UK business, or that your business plan is viable and credible. Your application is therefore refused under paragraph 245DB(f) & (h) of the immigration rules.

Above is the exact wording of the summary of refusal letter.

Requesting Interview Transcript

Post by engrashok » Thu Jul 25, 2019 9:08 am

Hi All;

Appreciate if you guys could guide me with the exact procedure (channel, form and so on) of requesting interview transcript and video recording from home office?

I have tried a couple of methods but none worked so far.

Thanks

They sent my interview transcripts after nearly one month

Audio transcripts will be only sent to uk address not overseas

When is your deadline to submit AR ??

Even if you take time, make sure you send them strong reply

What was the exact reason for your refusal ?

Was it contradiction of answers said during interview ??

Reach them through email

My post and link has nothing to do with not permitting sharing official HO email addresses!

HO email addresses can be shared as long as they are published emails and generic ones, i.e. not naming a person.

I got full 95 points however refusal was due to contradicting answers in interview, specially on breakdown of investment and staffing plan.

Once you paid and submit they will escalate to relevant team

Important note - They will never send on time so check the date of refusal on your application and calculate 28 from it and submit your AR before that

Don’t give up, if you think you did well

Note - what is the nature of business you intended to do in uk , do you have any prior experience?

Did you mentioned about your experience on interview,

How many pages AR you submitted ??

Did you submit directly or through law firm ?

You don’t need to pay again for email, use the same email and reference which you were using before
