Can i vary the application without giving Biometrics?

Hi,

I have submitted an online application yesterday for a spouse visa, the current visa is expiring on 11 Aug. I am planning to vary the application in the first week of September. I have time until 12th of October for biometrics. Shall I give biometrics and then vary or can I vary it without giving biometrics?

You are not getting a response likely because no one on the forum really knows if it will work. FLR(M) has different requirements and falls under completely different immigration rules.

Hi CR001,

Do you think that the scenario in the below post is exactly as mine, he had 3 days short of meeting maintenance requirement whereas I have 28 days. If he varied the application after 3 days, submitted the statement until the date of the new application and got the visa approved. It looks like I can do the same, just wanted to reconfirm with you.

The difference for that user was that they could still apply by post and the date of application is the date of posting the application to HO.

This is no longer relevant as postal apps are not possible anymore.

Thanks for the quick reply. I just had a look at the old visa variation guide when postal applications were available and it says exactly the same for visa variation application date. Please can you check the page 17-18 of the guide in the below link:

I don't have personal experience with variations of applications. You should follow the rules/guidance notes if you wish to take the chance.

No worries, thank you very much for all your help, advice and support. I think I'll take the chance and I'll keep you posted. If for any reason, the variation didn't go as planned and PBS dependent extension gets refused, can I then be able to apply FLR(M)again?

If PBS dependent is refused, she MIGHT be offered FLR(FP) 10 year Partner route. If it is refused outright AND her visa has expired, she might only be able to apply on FLR(FP).

Sorry, I am a bit confused here. Don't you get 14 days after the refusal to make a new application? If so, why won't I be able to go for FLR(M) within those 14 days?

Likely because she will be making an application out of time.

Now, this has really increased the risk now. I spoke to a couple of immigration lawyers and they said the variation should be fine. I was under the impression that I would be able to apply for FLR(M) if this all doesn't go as planned. But now the risk seems very high. What do you recommend, shall I stick to FLR(m) that i have applied already?

Hi All,

My visa was expiring on the 11th of August and i submitted an application on the 8th of August, so my application was submitted in time.

Now i want to vary my application, while filling out the form, came accross the following question.

Was there a reason beyond your control why you did not apply before your visa or leave to remain expired?

I did apply before the expiry of my visa and this is a variation application which i have already mentioned in the start of the form. What shall i do about the above question? Shall i just explain the situation and variation?
