Long Residence (10 Year Route) Continuous Period

Post by vicki2001 » Tue Aug 13, 2019 3:23 pm

Hi,

I was in a ICT long term visa (stayed 5 Years in UK) and have recently moved to Tier 2 General dependent (my wife's dependent).

My employer asking me to move to India and work form there for some time (~8 months).

Could anyone please help if being out of UK (8 months) in one calendar year will have issue while I apply for ILR?

I can break this 8 month duration in multiple entry, say 3 months + break in UK + 3 Months + break in UK and so on. Doing this, will I still be eligible for ILR?

I see the below information in gov.uk

You can leave the UK during the continuous residence for up to:
  • 180 days at a time
  • 540 days in total
Appreciate your help here

Thanks

It is not based on 'calendar year'. It is ANY absence of 180 days in one go.

Many thanks for quick clarification.

Do you recommend getting confirmation from Immigration solicitor as well?

Thank you!

Why, the immigration rules are very clear on this point for long residence ILR.

Hi CROO1
i am bit confused about 180 days if you going for ILR via long residency route(10 years)
the new rule which changed in Jan,2018 is applicable on ILR via PBS or on both 10 years and PBS?
if it's also for long route like any 180 of any 12 months that will apply for last 5 years or 10 years on long route?
i am going to apply for ILR(10 years) in October and i was absent in 2014-2015 in 12 months period more then 180 days(but not consecutive 180) as its not in last 5 years if i concider from day of application so that will affect?
reply will really be helpfull
TIA
