New ILR guidelines effective Jul 08

Post by rajesh_kksh » Fri Jul 11, 2008 2:50 pm

Hi,

After going through the UKBA site, topics already discussed in this forum and getting more confused than earlier, I finally am posting this topic. Hope someone could help. As the UKBA website is constantly changing, I could see that the ILR guidelines have also been revised effective July1, however I could not see any clear guidelines on the rules and policies around this. I am on Work permit here since 2006 (valid till Dec 2008) and plan to apply for tier1 this year.
Could someone please advise.

1) After how long can one apply for ILR and Citizenship (Is it 5+1 years?). What is the latest policy regarding how long can one stay at a time outside UK and overall ?
The last I heard about this it was 180 days in 5 years and not more than 90 days in last year. Has this changed ? Do I break my 5 year period count if I stay outside UK for more than 90 days at a time even though overall it is less than 180 ?

2) If there is any link on the UKBA website detailing these , please send me that. I got the SET(O) forms (applicable for HSMP and WP holders) link - http://www.ukba.homeoffice.gov.uk/ukres ... ormset(o)/ from the website , but the guidelines are not very clear.

Please advise.

Hi,

Ok, the above link is not working if you click it. If you add manually a (o) at its end, it does open the link. Heres the correct one. http://www.ukba.homeoffice.gov.uk/sitec ... orset0.pdf the version is 06/2008, so they must have updated something though I am not sure what all.

Thanks,

Hi,
Exactly, they have not mentioned regarding the 180 day rule. Infact, I think they have not mentioned anything useful. So could you please advise on the questions that I asked initially ?
Thanks.
