spouse visa extension

Post by dreamer2 » Sat Aug 31, 2019 6:42 pm

I'm asking for my friend. She entered UK on 10th Feb 2017 but her BRP is expired on 1st November. She already submitted her application as she is more than 30 month in UK. Didn't she apply to early? I believe it says not sooner than 28 days before the visa expired. If so, what she can do? Can she cancel her application and submit it later?

It is 28 days before reaching 30 months residence OR before visa expiry!!

No need to cancel now if all the required documents are ready. But preferably unless the immigration rules/personal circumstances are not changing the extension should be applied very close to expiry to avail the maximum length of visa while avoiding every single chance of any shortfall in qualifying period for ILR.

Sound like she will be ok then. It is so much confusion with this 33 month BRP. And she should be ok then for ILR too.

Initial spouse visa usually have few extra months. In your case you won't have shortfall because you even have applied after 30 months and almost same length of visa (30 months) you will again be granted. You can also apply ILR 28 days before completing 5 years/60 months.
