Need advice for 70 years Old Lady

Hi

My friend intends to apply for his mother to stay in UK, currently she is on visit in UK, 70 years of age and no one back home to take care , Father died. He himself is on ILR not national of UK yet however dual National of Canada / USA. which application he can apply for his mother for Leave to remain via same day service.

Hello,

The application is called "Adult Dependent Relative" or ADR.

She can't apply for it from within the UK. She has to go home first and only lodge the application from there.

The risk of refusal has been evaluated at 99%. This means that it's nearly certain that the application will be refused.

After the refusal, her situation won't be the same as future visitor visas would be declined.

He stands more chance of her staying with him in USA or Canada as hey permit chain migration.

For an adult dependent relative visa, I suggest you read the links below carefully as if you are refused, it shuts the door to any future visitor visas. The ADR is the most difficult visa to get since the rules were toughened in July 2012.

Additionally, for a visitor visa she would have had to prove her ties to home country (social, family, financial etc). Did she lie in her form and present false circumstances??

The only way forward is to actually apply ADR then try for an appeal once refused. Again you will risk not being able to apply for a visit visa..

Most manage to get a visa resulting in a breach of human rights.

It is a sad sad story when ADR cannot be looked after by dependants due to strict rules..the EU make it very simple and cheap to do.

One can only hope rules will relax for both spouse and ADR after brexit.

Husband's timeline - overstayer 11 yrs
08/16 - FLR (FP) Partner, refused 02/18, 03/18 - JR permission refused with merit
08/18 - FLR FP (Partner) PSC - Approved
07/20 - FLR FP to FLR M Switch - Approved, 03/23 FLR M Ext Approved.
