Travel while Tier 2 extension is in process

Post by matu83 » Tue Feb 19, 2019 1:18 pm

Hello,

I have applied for my Tier 2 visa extension last week.
I am travelling for work at the end of next month and afraid that the decision won't be made by then.
The travel dates fall exactly on my current Tier 2 visa expiry date and I will be back in the UK after it expires. My CoS states that I need to leave and re-enter the UK during the period of approval. Will this be enough to re-enter? Do I need to present anything else?

Thank you.

A CoS is NOT a visa.

Traveling out of the UK could cause your application to be withdrawn. If you are out of the UK and your visa expires and no decision made on your application, your Section 3C ends and you won't be able to re-enter the UK as a Tier 2 migrant. This will then kick in the 12 months cooling off period outside the UK before you can return.

I can not stress enough the importance of not traveling out of the UK during the application process and in particular if your visa expires while out of the country.

Please do not attempt the trip as it will only end up in one thing - refusal at point of entry, potentially a short stay in detention and a return home. The cooling off period will kick in and possibly a further ban on all visas applications for a minimum of 12 months.

Thanks for the advice. Does anybody know why this rule is in place? I am meant to travel to Denmark next week from the UK, but will likely have to cancel, because I haven't received any update on my application.

1. You should start your own topic rather than tagging onto an old one.

2. As you applied for standard service on 12th August and biometrics appointment on 17th august, it is an 8 week wait. If you knew you had travel, you should have used priority or super priority service to get a quicker decision.

I don't have a magic money tree to pay for the priority service, unfortunately. I wasn't aware of the rule when I applied, I'm simply asking why it is in place. It really doesn't make much sense to me when I currently have a valid BRP for my dates of travel. The whole system sucks, and we shouldn't be supporting it by paying extra money, which may or may not be necessary depending on how busy they are.

Hi! I just want to ask, by decision you mean once I get an email of successful application or do I need to receive the new BRP before I can be allowed to travel? Thank you so much!
