FLR M late application and finances issue

FLR M late application and finances issue

Hi
I arrived on spouse visa in Nov 2016 and applied for first extension in Jun 2017.
Background:
I had two issues with my application.
1. applied 2 days late (after expiry of BRP) due oversight, but online application was actually started before expiry.
2. did not met the earning criteria as my partner was out of job from last 6 months. At the time of application she had a job offer (30k job) but it was just an offer letter.

Current situation my question:
after 3 months since applied we are now contacted by home office via email asking weather my wife started working or not for that job offer? Secondly they asked about my job details which were little eranings in 1 year prior to visa expiry. We replied that partenr now working on a 30K job (a diffrent job not for which offer letter was attached) and attached evidnace.

My questions:
1. should we be hopful for a positive out come, since partner now on 30k job?
2. when they ask you for docs are they enclined to approve visa?
3. would they again take months to decide?
4. since they are asking info, means they have ingnored late application?

i am realy worried please advice..thanks a lot..

Applying after visa expiry means you are an overstayer.

Date of application is the date you submit and pay online. When you started the application is irrelevant.

First of all many many thanks for reply..plz shed light.
since they asking for docs, so have they ignored overstay? or its just a process ?
also would that make a diffirene that wife (sponsor) now earning 18600+..?
Plz share your thoughts i am in total darkness at the moment.

1. If there was no sufficient income until the date of application then they may switch her into 10 years of route.

oh you gave me a big hope, but i heard they only consider if kids are inlvovled and also would they ignore late application combined with income issue?

They can still switch you into 10 years flrfp route without kids which they usually do where the applicant can't meet the sufficient income requirement/overstayed/incorrect English language test etc. Equally they can refuse as well without switching into flrfp by themselves.

One last question...
Please look at the following wording of email from HO..word CLAIM means they are now at a stage where they looking at application under article 8 ??
''Thank you for your application for leave to remain in the UK. I am now considering your claim.
I am requesting further information that I wish to take into account:-''


Email is from EO (executive officer) means its with senior CW now?

plz give you views..

Maybe your case was complex and caseworker has liaised with his/her supervisor (senior person) and he given you this update regarding your case is with him/her now.

unfortunately extension refused with right of appeal, going to appeal now within 14days.

What does the refusal letter state exactly?

Does the letter not offer you to pay IHS for flr fp?

You applied out of time, not sure an appeal will help, considering it was your mistake.

They may paid IHS for the application that was refused.
