Settle persons spouse

Hi All,

I HAVE INDEFINITE LEAVE TO REMAIN. I WAS ON TIER 2 WORK PERMIT AND SETTLED ON 26/06/2019. MY WIFE STILL ON MY PREVIOUS TIER 2 DEPENDENT VISA WHICH IS VALID UNTIL 06/2020. HOME OFFICE DID NOT CURTAIL HER VISA YET.

MY CONCERN: SHOULD I APPLY TO CHANGE HER VISA CATEGORY UNDER MY ILR VISA OR CAN REMAIN ON TIER 2 DEPENDENT VISA WHICH IS VALID UNTIL 06/2020? PLEASE ADVISE.

On what basis did you apply for ILR, 5 years Tier 2 or 10 years long residence?

Also, please do NOT post in CAPITAL letters, it is difficult to read and consider the same as SHOUTING!!

Not sure why you think her visa will be curtailed.

She needs to switch at some point to FLR(M) and meet the English and financial requirement. She should also not travel out of the UK until she has made the switch.

Note that the sooner you switch her visa, the sooner her clock can start for her ILR based on 5 years residence.

Thanks, so if I make late application there will not be any problem like over stayer. Because she is on TIER 2 dependent and my status is changed to ILR. Even though her visa valid til 06/2020. Is there any time line for such switching or we can wait until her current leave expires. Regards

And it's probably best not to wait until her current leave expires. It will be better to apply before it expires.
