PBS Dependent Visa

Hi

I got married in May 2018 and my wife came to UK in July 2018 as a Tier 2 PBS Dependent. I got my ILR on 13/09/2019 (on the basis of 5 years stay on Tier 2 General). Now i need to extend my wife's visa as it is expiring at 25th October.
1) Can i still apply for Tier 2 Dependent Visa for her, even though i do not have Tier 2 Visa anymore
2) Do i need to apply for ILR Dependent visa for her based on my settlement visa. If that's the case which application form i should use for this?

1. Yes, the rules allow this. It will be a 3 year extension.

2. No, you do NOT have to switch her visa category, which would reset her 5 year ILR clock and has different requirements.

Hi

One more quick question on this - As my wife is here in UK for only 1 year 4 months, if she gets 3 years visa now. Would she be able to extend again on Tier 2 Dependent visa once she finishes her 3 years period?

Because to cover 5 years period 3 years is not enough.

Yes, she applies for another 3 year extension.

Hi

when i am trying to apply the IHS surcharge is coming up as 2200. Looks like it is calculating for the whole period of my settlement visa. Is there any way to reduce the IHS surcharge to 1200 (for 3 years) without impacting the visa result

Put your ILR expiry date as whatever date for October 2022.

Who you work for is irrelevant once you have ILR and has no effect on the PBS Dependent extension. Your dependent is not dependent on your tier 2 sponsor, they are dependent on YOU, regardless of where you work after ILR.

You do NOT need tier 2 sponsor letters for a PBS Dependent extension or PBS dependent ILR.
