British girlfriend with US passport

British girlfriend with US passport

Hi new to the boards just looking for some advice.

having spent a bit of time in the states recently me and my girlfriend have been looking at options for moving there.

She is a uk citizen as am i, however her father is from the US so she holds a US passport.

My question is how would we be best going about me getting a visa im in a highly technical job which i know companies in the states require but i would rather go out and think about a job when i get there. If we got married in the Uk could i get a visa through marriage or could i get a fiances visa and move to the states on that.

My concern is that even tho she holds a passport she has never actually lived in the US would this go against us.

also any good companies for getting advice from im not at the stage of getting a lawyer yet.

I don't believe you will be able to get a finacee visa since there is no US residency:

The first step in applying for a fiancé(e) visa is for the U.S. Citizen fiancé(e) (the petitioner) to file a petition on Form I-129F with the United States Citizenship and Immigration Services (USCIS) having jurisdiction over his/her place of residence in the U.S. Note: The petition can only be filed with the USCIS in the U.S.; it cannot be filed with the Department of Homeland Security (Immigration) at this Embassy.

You shouldn't have a problem getting a spouse visa if you are married in the UK, but to be sure I would see a Lawyer. There doesn't seem to be residency requirement, so you should be in the clear:

You would also have the option to apply for and immigrant visa through work, if you qualify.

Your girlfriend is also a US Citizen. She could not have a U.S. Passport if she were not.

YOur girlfriend can, and should, go to the Embassy, and make certain her citizenship is recognized. Then, she can freely travel back and forth, as she pleases.

As to you Visa, there is no real problem, so long as you qualify in all other respects. You don't need a "fiance visa", per se.

BUT, if you are smart, get married.
