Financial requirement, potential dilemma.

Post by Efficasy » Thu Oct 17, 2019 5:28 pm

Hi all,

My wife and I are in a bit of a dilemma.

I’m on 10year spouse visa and dues to renew in may 2020.

My current job £18900/yr is contracted till May 2020 (day before visa expires) employer is happy to renew contract providing I successfully renew my visa. I intend to renew by April- so technically I’ll still be employed as of when applying.

My wife, currently employed full time, permanent position for the last 5/6 years £19000/yr.

She has been offered new job with new employer at 22k/yr. it’s a pay rise and a job she has always wanted.

My worry is, if she takes the job now, she would have been in the new job less than 6 months by the time I renew end of April 2020.

Is there something I don’t know, will this be an issue ? Has anyone been able to meet the financial requirement with less than 6months in new job prior to making application?

If you are on 10 years route then there is no income requirement.

Really? No income requirement for 10 year spouse visa?
EX.1. Exceptions to certain eligibility
requirements being met by a partner or
parent in the UK
EX.1. – General
Where an applicant in the UK does not fall to be granted on a 5-year route as a
partner or parent because certain eligibility - financial, accommodation, English
language or immigration status - requirements are not met, they may still fall for a
grant of leave on a 10-year route if EX.1. applies.
Paragraph EX.1. is not a standalone provision under which leave can be granted.
Rather, where it applies, certain eligibility requirements under the 5-year partner or
parent route (as to immigration status, finances and English language) do not have
to be met. By not meeting the financial, English language or lawful immigration
status eligibility requirements, the applicant is not entitled to leave to remain as a
partner or parent under the 5-year route. However, if EX.1. applies to them, they may
be considered for the 10-year route if they meet all other requirements.
