Hi,
Apologies for bullet points, but figured that it may be easier to get straight to it!?

10 years ILR via work visas
Then Married 6 years BC
Applied citizenship on 10th of a month 2019 but was out of uk on this date 2016 (but was in uk 2014 on this date)
6 months and 1 day after application HO contacted her- wrong date, put date you returned from holiday - 13th of same month 2019 (so were in UK then in 2016)
Sent email of this date to caseworker and was advised 6 month clock starts again
Was not asked to pay another application fee

2 questions:
1-Is the date the HO looks at 13th of a month 2019 like they asked her to put and NOT the date 6 months later she was informed? (If 6 months later - ie now, she has been out of uk more than 90 days in this year now. )

2- can she ask them to look at her application under 6(1) in which case all info then was correct? Or does a marriage to BC mean that you can only apply under 6(2)? She sent her marriage certificate so I suppose was inferring that it was under 6(2).

1. This is restating the application date. Case officer can and has allowed within 2 months of original date, so your is fine. Application date is now 3 days later. Details in the case worker guidance on HO site.

2. You can apply for either as a spouse of BC or stand alone regardless. It is unfortunate the online form doesn't ask this explicitly. Even more unfortunate the case worker didn't consider this. Others here had the same predicament and tend to send a cover letter to make sure, if there is a problem with the residency for 3 years but OK for 5. In practice the application is likely to be fine as it has been restated and what you said. You may send an email or letter explaining but this may just prolong the consideration (no one knows) and likely nothing to gain.
