Visitor Visa Refused -

Hello

I am trying to help someone.

Situation: visitor visa refused for family member under paragraphs V4.2(a) and (c) of Appendix V (+ "I am not satisfied that you will leave the UK at the end of your visit or that you are genuinely seeking entry as visitor")

Details:
The applicant works in the medical field. She has held his position for 11 years. She receives 2 incomes from the same employer:

- Fixed monthly salary for which she receives monthly payslips
- Variable revenue depending on worked weekends, nights, extra-hour... for which another payslip is issued.

With her application, she provided her bank statement, but only the monthly fixed income payslips. As result, the caseworker wrote this:

"You state that you are not in receipt of an additional income however from the
supporting information provided I note large irregular deposits made into your
account from unknown sources. From the supporting information provided you have
not demonstrated the origins of these funds and I am not satisfied that these funds
are genuinely available to you for your exclusive use. I am not satisfied that you have
shown an accurate reflection of your personal or economic circumstances"


Also, the applicant father is deceased and she is the sole career of her elderly mother. She failed to mention that in the cover letter attached to her application.

Other issue, while she received an invitation from the UK with a sponsor offering full expenses for the trip, she added a letter from her husband explaining that he will be giving her £1500 towards the trip. In the refusal letter from the Home Office, her husband is designated as sponsor. It seems due that due to the intrusion of her husband in the application, he was considered as sponsor and not the British sponsor.

Note: the husband has a 3-year visitor visa to the UK, so he wasn't applying.


Question:
In practice, does it worth it applying again immediately and fixing the errors?

- Adding all payslips to better represent her revenue
- Demonstrating that she is a sole carer of her mother
- Re-stating, that she has 1 sponsor only, who is the British family member


As their formulate it in the refusal letter, each application is considered under its own merits. As the initial application was far from perfect, I believe that the original caseworker didn't get a correct picture of the situation. Do you think that placing immediately a new application with all points above addressed would worth it or there is little to no chance of success from this point?

You are in the same situation as me...i am also confused about applying the visa again for my sister and her kids...they refused the same basis which was unfair as they should ask for documents if they are not satisfied...i m really disappointed with their service as i applied for 4 people and the fees is non refundable...nobody can waste their money by just applying again and again...i m british citizen and applied for my sister...they were really unfair with my case as my brother in law was the sponsor for the money...we showed every single thing and explained everything in details still they refused...they just want money and not give visas...

I think main objection in your case is the additional income. If you can demonstrate this clearly then she can re-apply again.

If she is working and have savings why would husband pay £1500? Keep it simple.

Also write a cover letter explaining personal and financial situation.

yes, I understand how frustrating it can be :( They are paid a lot of money for the time they spend on these visas but they don't seem to use any flexibility. They have all the contact details of the applicant, but the application is dusted without further inquiry and the money lost in case of refusal.

Anecdotal evidence from someone I know (family), they have been told they would increase their chances for a visitor visa if they apply without the kids. If the kids stay back home with grand parents, the chances for the couple of getting a visitor visa to the UK is much higher. If they apply couple + kids, risk of refusal is higher.

I think main objection in your case is the additional income. If you can demonstrate this clearly then she can re-apply again.

They talked to me before the application and I recommended they keep it simple + they explain their circumstances. In fact, they just sent a half backed application...

They can re-apply but need a detailed cover letter explaining the financials clearly and ties to home country.
