What counts as "established links to the UK"?

Post by cantab » Mon Mar 31, 2008 11:14 am

Hello everybody.

It appears that it is possible to apply for British citizenship through naturalisation while having less than 12 months of no time restriction on one's stay in the UK (ILR). The guidance mentions that if the time restriction was in place for between 10 and 90 days at the beginning of the 12 month period (before the application for naturalisation), the authorities may exercise discretion, provided the applicant can show

"established links to the United Kingdom though your home, family and larger part of your estate".

Does anyone know what the authorities mean by it?

I have a house in the UK (had it for the past 7 years), have lived/studied/worked here for the past 11 years...

Thank you for any information.
Aidyn.

Well, it looks like it is possible to apply after 9 months, so that makes it middle of may?

Did you apply before fulfilling 12 months of ILR? What is the chance?

Many thanks

It also states that "if you have not been free from time restrictions for 12 months, we will normally use our discretion to disregard this if ...
* the time restriction was in place for less than 10 days at the beginning of the 12 month period;..."

Why would this be relevant so that they might use their discretion to disregard????
