Tier 1 renewal - After JR Implementation

Hi,

I got my HSMP on Sep 2006 and after waiting for 2 long months (for the JD arrangements), i decided to submit for extension under Tier1 (I should hopefully qualify).

However, i noticed today that BIA has published a document regd the JD review.

The document states that, if an application has been submitted, it will be considered under the HSMP rules in place before Dec 2006.

Since i would like to be considered using the old rules,

a)Will it be done automatically as given in the document?
b)Should i write HO a letter stating that i would like to be considered under the old rules
c) Will i get an extension under TIER1?

Appreciate any insight provided.

Hi,

Called HO and got the below reply,

a) First, your application is evaluated against TIER1. If sucesssfull, then you get extension under TIER1

b) If (a) is unsucesssfull, your application is evaluated against the Old HSMP rules. If qualifying, you will be issued extension under TIER1.

Therefore eventually you will end up with a TIER1 irrespective of the qualification method.

I feel this explanation is a slight contradiction of what the JD document states. Any insight is appreciated.

Hi,

Got a reply for the home office regd my query,

My Question was,

"My concern is that if i my application is currently accepted under TIER1 PBS scheme, then will i be able to apply for an extension according to the old HSMP rules when the renewed LTR expires? (after 2 or 3 years ) or will i get "transferred" into the new scheme and will have to extend using the PBS?"

Answer is,

"The main criteria is that you have had a HSMP approval and applied before 7 November 06. So you can retrospectively apply to the 'old' HSMP even if you get Tier 1 approval this time"

Hi ,

Once you get your FLR,Can you pl. answer following Q

1)When did your Visa expire/your current leave is expiring??
2)For how long did they give u FLR for??exact 3 years??Or till you reach ILR? HO says that they will give you extnsion till you reach ILR OR 3 years which ever is more..
3)WHAT is written on your VISA???HSMP or TIER1 ??
