spouse visa settlement questions

Post by sddxac » Fri Nov 29, 2019 3:24 pm

If I am settled in UK(via 5 years working visa), I think my wife should apply for spouse visa and can then apply for ILR after 5 years. I got a few questions:

1) Is there a limitation on how many days she need to stay in UK every year if she want to apply for ILR after 5 years
2) If we have a child born outside of UK, can we apply for ILR directly for the child?

Thanks for anyone's advice in advance.

1. No absence limit but heavy/unnecessary absence might make the cohabitation evidences be weaker which are needed for extension.

2. No assuming you have ILR but not yet British national.
The opinion expressed as above is neither a professional advice nor contesting/competing to other member's opinion/advice.

If your spouse is a pbs dependent visa holder, she does NOT have to switch to a spouse visa and can apply for ilr shortly before 5 years on PBS dependent visa!!
