Rejected asylum seekers given 'amnesty'
Hundreds of thousands of asylum seekers will be allowed to remain in the UK, with the Home Office accused of failing to make inroads into a huge backlog of cases.

The move has been described by shadow home secretary Dominic Grieve as an "effective amnesty".

Two years ago, 450,000 asylum cases, some dating back to the mid-1990s, required processing and only 90,000 of the files have since been processed.

Courts will now block certain deportations on human rights grounds as some of the asylum seekers have lived in Britain for so long.

The asylum seekers allowed to remain in Britain will be able to claim benefits and gain British citizenship.

Grieve said: "This exercise should be about reviewing applications properly and granting asylum in genuine cases.

"The government should not be tempted to grant an effective amnesty just to get the backlog cleared, and achieve a good headline."

Of the 1,013 foreign criminals found to have been living illegally in Britain, just 308 have been deported. Charles Clarke was sacked as home secretary over the scandal in 2006.

On this issue, Grieve said: "It is outrageous that over two years after this scandal cost a home secretary his job, the government still have only managed to deport less than a third of these foreign prisoners and haven't even found over 100 of them."

A Home Office spokesman told Friday's Telegraph: "Significant progress has been made: ninety per cent of these foreign criminal cases have either been removed, told by a court they can stay, don't meet our criteria for removal, are currently serving prison sentences or are in the process of being deported."

does anybody know anything about secret amnesty?
im kind of confused because i think thats a good news for people .. but is it certanly going to happen?? any comand??

The "amnesty" is the asylum case resolution programme that people who previously applied for asylum and were rejected are now entited to apply for. They fill in a questionnaire and, at some point in the future, the BIA gives them a decision as to whether they are eligible to obtain ILR.

An amnesty has been ruled out. If you have previously applied for asylum, you might fall under the Asylum Case Resolution. Otherwise there are no plans for blanket regularisation of non-legal residents.

my case is considered as a legacy case. the team who's dealing with my case is Liverpool 8. I would be grateful if you would be able to tell me what are my chances of getting ILR. my story is:

failed asylum since 2002

married to BC have a son who's BC too

home country is Algeria

reporting monthly to the immigration office

having an outstanding fresh human right claim without reply since October 2007

news says "amnesty". daily express newspaper web site has the news. if you check it you will see. there are other newspapers you can check.

i was reading the news today thats the way how i found it. so if you check online telegraph , daily express and bbc , you can read thesame news..

this is not secret amnesty, the same article (with slightly different wording) has been in the world for the past about 2 years. As said above this is a case resolution program to clear a backlog of failed asylum and outstanding asylum applications.

when and who is gonna benefit of this resulotion program?? do you think my lawyer would know the details ,or is it to early to say something ?? what s your opinion??

it will benefit failed asylum seekers and applicants who have outstanding initial claims like wat tasha has said. it will only benefit asylum seekers who claimed asylum before march 2007.

do you think I could benefit from this amnesty as I'm failed asylum since 2002 and my case is considered as a legacy case.

this so called amnesty is legacy cases like i said before. there is no amnesty it is the legacy cases that they are referring to in the press.
