help for Financial requirements for FLRM ILR

Post by lala1234 » Tue Nov 26, 2019 10:26 pm

Hello

my case is question very complicated

I am a dependent wife of british husband, and about to apply for ILR in january 2020. I am not working because a house wife full time.

My husband is company director and shareholder whose company accounts due on 28 February each year. My husbands last financial year earnings was 12k. my husband is employed by his company since January 2019 and his pay is 1000 pounds per month. he has earned dividends in past 12 months which are 8000 pounds so far so total earning in past 12 month is 20k from January 2019 to December 2019( dividends earning can only be shown in management accounts before visa is due in January 2020, because company accounts are due in February 28 2020)

however company accounts submitted for the period of 28 febraury 2018 to 27 February 2019 show gross profit of only 1800 and my husbands total earning in last financial year was 12k.

so in last 12 months my husband earned 20k ( 12k salary and 8 k dividends), but will the home office accept dividends earning which can be shown through management accounts by the accountant?

i would be grateful for the help

Have a read of the guidance document linked below for meeting the financial requirement under Category F or G (from page 60). You can use earning from dividends, but they have to be earned in the same period covered by the Company Tax Return (last full financial year). You would also have to provide personal bank statements showing the dividends were paid.

thank you Geong for the reply

just One more question

my husbands company accounts are from feb 2018 to feb 2019 since last 3 years( already submitted and had income of 12k required is 18.6k). and my visa due date is 10 january 2020. the next company accounts( which will have 20k income) will not be due before visa the date of january 2020. if my husband change his companies annual accounts date from february to december from companies house making it 2 months earlier, and submit my next company accounts in december 2019 just before my visa due date of january 2020. which will show all dividends and required income of last 12 months.

do you think its a good idea or not?

READ THE GUIDE above !!!
The UKVI will use the latest tax year as per previous CT600. You cannot trick them :!:

thank you for your response

there are couple of things still confuse me

1, when i attach husbands company ct600 for latest company accounts it made 4000 pounds profit in that year, however my husband made 19k in form of pay and dividends( from 6 april 2018 to 5 april 2019). does it matter how much company made in last ct600 accounts? is there any thrshold?

2, the husband salary is 1000 pounds per month, which he withdrawn in his personal account bit by bit some times 100 some times 500 at different dates does it matter as he is the sole director of the company?

3, he also withdrawn the part of his salary into his personal business account with his name on the bank account and statements, is that ok?

regards

Please read section 9.8 of the guide telling you what you need to send. You really need to read that document as repeated several times.

You must first choose your service and pay the fees and submit the application on the UKVI website. Afterwards you will be given the link to sign up with UKVCAS to get an appointment day. Due to large demand, UKVI may not offer you a super priority service option.

You must have ticked a box somewhere in a previous page that you have a representative which is why it is asking for this detail.

No, it is spouse of settled person.

You have to apply for ILR on form SET(M) if you have held a spouse settlement visa for 5 years.

All services available to you are offered to you online as part of the application process. If only standard service is available, then that is the only option you got

So can you please advise what have you decided. I am in a very similar situation. My last ct600 was from
March 2018 to March 2019. However I have decided to shorten the current financial year to Jan 2020(so April 2019 to Jan 2020. ilr due in Feb 2020) . In both years my dividends and salary combined meet the financial requirement.
Have you used the April 2018 - April 2019 year or the shortened account till Jan 2020? Also how have you addressed the payments going to your personal account(salary and dividends have to match exact dates and amounts)

You can't shorten your tax year to qualify for a visa. It has to be the last FULL financial year corresponding to a 12 month accounting period :!: :!: READ THE GUIDE (section 9.3): https://assets.publishing.service.gov.u ... -ext_1.pdf

The last 'full' financial year is open to interpretation so am quite confused - can you pls see the below post.
Isn't it the same scenario?
