I am a husband of irish citizen !( i.e national of republic of ireland) i got married in june 2014 and at that time my wife wasnot working shestarted working in oct of 2014 i applied for my rc in 2015 which was refused because of stupid reason by homeoffice in 2016 and i appealed and i won my appeal in my first hearing in jan 2018 i got my rc in aug 2018 and in april now the issue is we have separated not divorced since aughust 2019 and she doesnt want to live withme as i foundout that she was seeing someone else she been working all along through this time no the thing is she has moved out with her new guy and asking me to not contact her or else she will report me to police and she is not willing to give me her id as she is saying she lost it which is a lie i know she just dont want to give me her id and i have all text messages record
Now my questions are as follows
1 when does my time start is it from the date i got married or the date i got my resident card ? Bearing in mind at the time when i got married i was visa overstayer
2 is it better to apply for settled status as separated couple or shall i apply for divorce and then when i get my divorce apply for retained rights and everything? And the problem with taht is she i dont know where she moved to since aughust as she is threathening me with police and stuff?
And what eveidence willthe homeoffice ask for as i have scanned copies of her payslips and bankaccount and her id from my previous case and the recent ones as weused to scan and save them but thats also from God may he knew what she was going to do with me!
And divorce will take long because i dont know her address andshe is not willing to give me her new address
Please i need seeious help if you guys can help me out there with your experience and kindly let me know what i need to do as i have seen bare lawyers and all of them that i have seen are money grabbing thugs and trying to ruin my case and my future every little help matters please in need of serious help

I got married in june 2014 at the time i got married i was an overstayer
Apply for residency permit it got refused appealed in ftt and won my case in january 2018 and got my rc in aug 2018
My partner started working from 1st oct 2014 a d through out she been working
From oct 2014 to march 2018 she was working on payee with a retail company ( i have all the payslips)
Then in march company closed down and she was redundant
In may she started working from home and registered herself as self employed and submitted her tax return in april 2019 for year 2018_19
And i know she been doing really good online and she been working now the point of concern is this that in August 2019 we separated i dont know her addres she is with some other guy and she is not willing to give me her id or anything but i have got her emplyment history and bank statements scanned in my system for every month and i have her id scanned too because we used to scan everything that used to come through post every statement every letter every payslip and everything i have her birth certificate too she is irish national
Now i am trying to contact her to give me her id so i can apply for my settled status but she is not willing to cooperate she says she has lost it and she doesnt want me to contact her or else she is threathening me that she will go to police and report me saying i am harrasing and i dont even know where meaning i dont know her new address i have all the record of the convo too which i am having i cant have divorce because i dont know her address but we are officially separated and i cant deal with this stress no more if i dobt give homeoffice her original id they will refuse my settled status application and if i send them her passport copy she says she has lost it now i dont lnow what am i going to do i did everything to save my relationship but thegurl doesnt want to hear my voice let alone give meher id i dont know what i am going to do i have her employment record till april 2019 as she is self employed so obviously she will do her tax return for this year next year so i am really stressed and for summary my time line is below pleaseguys please help me my everything is on the line and i dont know what to do

I believe your best start is to first apply for Permanent Residence under EU law, as under that path one can apply for Amos direction if refused.
Once your PR is received, you may switch to settled status.
It is difficult to get into settled status without some of the documents that she is refusing to give you.

It will not be easy, but at least there will be a right of appeal. Furthermore you have documentation, but they all seem to be copies.. May help if you proceed with divorce if the marriage has ended.

You may send papers to last known address or apply to dispense with service. You could ask her for address to serve papers.
Birth certificate is not an Identity documents.

Good evening guys
I am not sure if any of you can give me an answer.
Me and my wife been living separately since first week of this month and we will process our divorce at some point end of February or beginning of march. However, I will be traveling out of UK in January and return on February middle, while coming back to UK, do you think I could be in trouble as we don't live together ATM? And as we have agreed verbally to get divorced as things were not working out.
We have been married for more than 4 years and currently I am holding residence card as well as pre settled status.
Also, if she wants can she get my status curtailed? Is there any chance of this worst scenario while coming back to UK from holiday?
Please, only expert answer these questions. Thanks
