ILR for dependent of long term resident (10 year route)

Hello,

I have got few questions on ILR for dependent.

Myself: Entered UK from India on 1-August-2011 on ICT Established staff visa (rules before 2011 April)
Spouse: Entered as depended on same day (1-August-2011). Left UK during birth of our daughter on 12-March-2014 and returned on 30-Nov-2014
First Child: Born in India in 2014 June and arrived on depended visa on 30-Nov-2014
Second Child: Born in UK in 2017 and have Indian passport and dependent visa

Could you please help me with the following questions?
1. I believe I am eligible for ILR in 2021 May?
2. Can my spouse continue on dependent visa after my ILR?
3. If not can spouse apply for any other visa until Nov-2024 (Student or Tier 2 General) to complete 10 year?
4. Is it the same case for both of my children?
5. Does it make any difference that second child was born in UK?
6. If I do not apply of ILR and continue on current visa (or change to Tier 2 General Visa), can we all apply for ILR in 2024?

?
In July/August 2021, no sooner than within 28 days before the 10th anniversary of the date you entered the UK.
2. Can my spouse continue on dependent visa after my ILR?
She has to switch to FLR m spouse visa and meet the English and financial requirements. Her 5 year ilr clock will be reset to zero.
3. If not can spouse apply for any other visa until Nov-2024 (Student or Tier 2 General) to complete 10 year?
Yes, see #2 above
4. Is it the same case for both of my children?
Yes, child born abroad eill have to switch to FLR M visa with your wife.
5. Does it make any difference that second child was born in UK?
UK born child can register as British once you get ilr.
6. If I do not apply of ILR and continue on current visa (or change to Tier 2 General Visa), can we all apply for ILR in 2024?
Yes, 3 individual and separate applications except for UK born child.

About question 5: Is it still OK the UK born child has a Indian passport & VISA? I have heard people not applying Indian passport if they need British one straight away.

Your UK born child will lose their Indian citizenship on the date reflected on their British citizen registration certificate.

Makes no difference to the entitlement to register as British if the child has another pssport.

Thanks Again.

I have one more question.

My partner is planning to study here. Can she apply for student visa when I change to ILR and then apply for ILR in 2024 when she completes 10 year?

This means she would have had Dependent visa for 7 years and Student Visa for 3 year after that.

She can apply for any visa she qualifies for and yes, if she has the funds to prove her maintenance and international course fees for a student visa.

All visas count for ILR based on 10 years long residence.

I am of Indian origin and legally staying in UK for 10 years. I am eligible for ILR by 10 year route.
The application asks for the following details
1. Spouse passport and visa
2. Childern's passport and visa
3. Employer details

My understanding is - there is no need to provide these details while applying via 10 year route.

Could you answer the below questions?
1) Will my employer be contacted to confirm my residency in UK
2) Why do we need children's passport - My younger child was born last year and I have not applied for passport yet. My intention was to apply for British Citizenship for my child born in UK as soon as I get my ILR.

The documents requirement shows that the passport for children are required. But my new born do not have a passport yet.

2. The form is generic and those documents are NOT required at all. SET(LR) has nothing to do with your dependnats

I have only the one option shown currently (Standard Service). Do I need to check it later in the day to get the priority option?

Yes but UKVI may not offer it due to high volumes of requests. Your options are limited to whatever offered
