they do the same to me whenever I raise my intention to make a formal complaint, they put me to a line manager who makes attempts to reassure me, their actions tells me they do not want too much complaints buffering in the zambrano or paper application route. One time I asked the agent how do I make an official complaint and he literally gave me the instructions how to contact the EU resolution centre online which is not the correct complain procedure and I know the agent knew. I already taken a different approach to secure my status ASAP recently and I wanna see how it works out.
Can't believe they wanna have people suffering for up to half a year n more.
Someone once told me with home office you got to be persistent and it could never be more a fact.
It's like they got the best lawyers n policy makers on their side and we got nothing until they give us something, the laws do not work that way. This is why they lose so much in court...
Keep the pressure on them, then seek compensation. They won't stop until they start paying money for the ruined lives.

Good afternoon fam, since receiving my biometric card, HO says they cant find my supporting documents like the P60s, children birth certificates and other letters I sent to them as evidence. I have called them 3times in less than 2 weeks and they says they are investigating where the documents went. So they will contact me in due course. Has anyone being through this b4? Help me thank God after 7months and over, I received my BRC this afternoon. But not the bundle of documents I sent. That hasn't arrived yet.

They also said they partially uphold complaint and expedite but no time scale.
How can they say they r still making enquiries as same application with same supporting documents under eea regulations they made decisions witin month.
Should i raise with them in complaint review?
Obviously they did enquiries b4 making decision my eea application. Now same rules to apply same document they wht do they mean still enquiries.
I think more likely they gona refuse EU Settlement Scheme application too as they follow same guidelines and old patel vs ssd is still there.

Just called EU resolution centre now, spoken with the quality control management team and they just seems to be saying the same thing of “waiting” in a nicer way that’s the way I see it. Sorry to hear. I don't think is write too. Since it's in the transitional period. All the rules still remain the same. I think you shd write to them and resubmit the application again telling the the rules hasn't changed so the shd reconsider the application. And quote some laws for them.
Or go see your MP to help write covering letter with a new application to send to them. Sorry to here.

So the HO is going to deny all our applications because the UK is no longer an EU member even though we are in transition?
So how can we be sure that we will be granted settlement after we get presettlement?
Are these people actually serious? If they are just going to say no on such ridiculous grounds they could at least say no instead of making people wait 6,7 8 months. Are these people aware people cannot survive, work, rent with no status? It is beyond cruel.

He kept on calming me down and told me that they didn’t pack away our paper application somewhere, that he was assuring me that I will hear from them within one month. I told him that I hope hearing from them within one month is getting a decision and not getting a COA, because if it takes them 4 months plus several phone calls from me, for to send me a COA then that means that it will be up to year before they make a decision. I told him I will have to go back to my GP to refer me back to the Counsellor for depression while I wait. He told me not to worry that everybody’s paper application doesn’t have to take 6months. Finally, he asked me to please not to worry and give them one month. Story, I shouldn’t worry, asking me not to worry is like taking the VICTORIA LINE TO MANCHESTER. IMPOSSIBLE.
I'm hoping Karen can come and clarify if it was under the Eu Settlement Scheme or EEA. But from the wording i'm guessing its under EEA because of the emphasis on the derivative residence card. It'll help us know the current situation of things
Hi, no Worries.... I will re apply again and make another application - it's the best way... Start from fresh again and see how it goes.. Yes, you are right, we can still apply for the application until 2021 july i think? Under EU laws... Im not sure, but... Whatever it is, won't bothered me anymore, I had anxiety and stressed before, after today I've realized I just be open minded and do it again and make the best of it...maybe just a mistake. . I have read your post but I still can't get it right.
This is because Home Office can't say to you that we are no more in the EU on a refusal letter. That is not part of any immigration law for refusal under immigration EEA REGULATIONS.
But if Home Office really said so then, you are in for compensation. This sort of thing is not law but someone's opinion and it Characterised as dearly beloved ideology.
You are not the first person to be told that. It was done to one Asylum moslem who had run from persecution and now a Christian
The case was that she could not follow a religion of hate and chose Christianity but the caseworker used some bible quotations from Moses era to refused the case
Home Office was taken to court and lost the case and paid huge sums
Home Office issued a comunique saying that it was the caseworkers on thought. The caseworker was jailed for bringing Home Office name into disrupt.
Britain is still in the EU until either 31/12/2020 or 30/06/2021.
All refused Zambrano's which met the requirements should have the right of Appeal.
Look for a solicitor asap to either do
1. Administrative Review or
2. Demand your appeal right
