Urgent help! ILR application while Admin review pending

What would be the consequences for the following scenarios:

1) What if AR is refused before 24 Jan 2020 and I apply for ILR within 14 days? Will I get refused?

2) if I don’t apply now and want to wait for AR decision (most likely refusal), can I still apply for ILR? Or I will lose my eligibility and get refused?

You can either wait for your AR to conclude or apply for ILR.

Under which rules and policies?

Am I falling under 39 E? As soon as I make ILR application while admin pending, I will be overstayer automatically.

You do not need to explain the rules to the UKVI
39E is not relevant here. You are eligible now as per rules on the day of the application. You will become an overstayer but that has no effect on your eligibility

I have read in this forum that some moderators have made comments as follows:

“You will need to have a valid visa on the date of application even you apply within 28 days in advance.”

In my case, I am already within 28 days period. My admin still pending. As soon as I make ILR application now, I will become overstayer as admin will be withdrawn automatically day before. Hence, I will not have valid visa on the date of application. Can you please double check this for me?

You do not need to have valid visa on the date of an application. Also, you are under section 3C which is considered lawful stay

I have noted from your previous comments that UK born child is not subject to overstay. I can register him for British citizenship once my ILR is granted.

Just want to double check, my son had visa in the past and he went for holidays outside of UK. He is now under my pending admin review.

Does he still qualify for British citizenship MN1 form and I don’t need to apply for him right now until my ILR is granted?

I have got my ILR and wanted to say thank you and this forum for guidance and support.

Here is the end result of my case:

SET LR

I received AR refusal letter 9 Jan 2020. I had applied for SET LR on 10 Jan 2020 and booked an appointment for 25 Jan 2020. I have got a confirmation email from HO that my application has been granted on 27 Jan 2020. Also, I have received the BRP card on 31 Jan 2020.

FLR M

I had also applied for FLR M for my wife on 10 Jan 2020 and booked an appointment for 15 Feb 2020. Financial requirements paper work and rest of the documents have been prepared accordingly and uploaded. Do I need a cover letter with the FLR M application? Do I need to explain any other reasons in cover letter to avoid an unexpected refusal by HO?
I did not include my child in her application as dependant.

MN 1

I had also applied for my child under MN1 on 31 Jan 2020 who was born in UK after receiving my BRP card. I have received an email from HO saying that they have received the application but it will take around 6 months to make a decision. How long does it take normally?
I booked his bio-metric appointment for 15 Feb 2020.

I would appreciate if Zimba or any other moderator can clear my queries above.

This is often the case for a single application. As Your FLR and MN1 are not related to this application please ask them in the respective forums

My wife received Bail 201 form and HO asked her to report to a reporting centre.

Even though her FLR M is still pending.

Do you know why? Are we going to get any surprise in the reporting centre?
