Tier 2 Dependant to Tier 2 General

Hi,
My wife is an Indian and her visa status is Tier 2 Dependant. She had been working as Junior Software developer with her employer for last 9 months. My visa (Tier 2 General main) is expiring in August 2920, if my wife's employers willing to sponsor her,
- Will she be exempted from RLMT?
- Could her employer issue cos with title as Junior Software Developer with new entrant salary of £25k ?
- Will she have to do IELTS or any similar course?
- Could she apply under soc code 2136?

Yo AKANTONY,
1. She will be exempt only if the work she is doing falls under SOC code 2136 (which I think she qualifies for)
2. I don't know. You may look for definition of 'new entrat'
3. If she can prove she has completed her studies in English medium. (ie a letter from her college or school which states that, that will be enough.)

If your wife is over 26 and not a recent tier 4 graduate, she will not be classed as a new entrant.

Hi CR001,
My wife's employers has agreed to sponsor her and they have applied for sponsorship licence. Hopefully will get it by middle of July 20. As our visa expiring on 14th Aug. Could she make application within UK? as I am thinking it is ok to make application within 3 months of expiring visa date ? Please correct me if I am wrong.

No. Being able to apply within the UK only currently applies to those whose visa expire on or before 31st July 2020.
as I am thinking it is ok to make application within 3 months of expiring visa date ?
She must apply from home country. Her dependent visa expiry date is irrelevant and she must leave the UK before her visa expires.

Am I eligible to apply for FLR to legally live in UK to apply for ILR through 10 year route as I am short of 6 months to complete this. I tried to get admission and seems difficult at this point.

Hi,
My wife's employer put an application for rcos on 02/07/20. Haven't received any further information on it. As need to make application before 31/07/20. Could someone advise if there's any priority service for employers to request for COS ?

The meeting for RCoS allocation already took place last week Monday. Has she checked with her employer what the status of the RCoS is on the system? Has HO asked for any additional information perhaps? Is the employer being honest with her?

There is no priority service for RCoS issuing. Only ONE meeting per month is held for Restricted CoS allocation, regardless of the urgency.

Unclear why you HAVE to apply before 31st July when your previous posts suggest your visas only expire on 14th August.

There is no way that you can speed up the RCoS allocation process.

I suggest she ask her employer what the system says. For all you know, the employer has received approval but not let her know or is possibly waiting to assign the CoS.

If the system still says it is pending, then likely HO hasn't approved it and might have asked for additional information from the sponsor.

Thank you for your message. Her employer in error requested for COS instead of RCOS. They have applied for it today but doesn't look will get it before 31/07/20 now. Don't know if there is any hope left as Lockdown is easing down and don't know if there will be further extension after 31st July which gives an opportunity to make application within the country.

Since the HO has extended from 31st July to 31st August grace period.
1. Am I right in saying my Tier 2 dependant wife could switch visa within without travelling to home country?
2. My 3 year old daughter travelled to India in February this year and her visa is expiring too on 14th August. She is in India as we decided at the time when my wife was travelling back not to let her fly due to cover 19 situation. In this case what shall be doing?

Hi ,
My wife is switching visa from Tier 2 dependent to Tier 2 General based on RCOS within the country due to grace period. She had done her BTech of 4 years from India (University of Kerala)and all her transcripts and awarded degree is in English. Does she need to verify with UK Naric ?

Yes, the NARIC UKVI Red Route, English and comparable assessment.

As the University is closed now we can't get the letter from them to state the course was taught in English at the moment. Is there any other alternate option to fulfill English language requirement?

Can you contact the university office? Even if there are no classes being held, the offices of most universities are open during the pandemic even if the employees are working from home. You can ask them to simply mail you requisite letter.

Hi,

I would suggest you to contact the university administration office for getting the MOI letter. I did the same, and that was 2 months back. I highly doubt they wont be giving now, given that the situation is way better that what it was.

Else, you will need your spouse to go for an IELTS exam.
