Can i have both BRC under EU regulation and settlment scheme

I have applied to upgrade my EU residence card to one under settlment scheme and I got it.
I have two quick questions please if you had an idea
I follow the other thread about changing brc to settlment scheme card but it doesn't have an answer

1) do we really have to send back the brc issued under EU regulation once we received the settled stauts brc? I know home office said in the letter you must send it and almost everyone upgraded sent the old one, but what happens if we don't send it back? Home office doesn't mention a fine just said it letter you must send it back, and i heard from one expert that you don't have to, home office is wrong and can't issue you fine because cards are not the same and it is still valid

2) assuming I'm gonna send my card to homeoffice can I apply for for EU residence card? Because it says on homeoffice website yes you can
But that contradict thier statement about sending the brc back to them in first place
