tier1 Entrepreneur number of days confusion

Hi Moderators,

I have some confusion regarding the number of days for ILR so one of my friend advised me to get help on this forum .

Tier 1 Entrepreneur issued : 10/03/2015
expiry date : 10/07/2018
first entry UK : 18/ 05/ 2015 to 27/05/2015 (for 9 days only)

came back with family to UK : 24/09 2015
further absences
January 2016 ( 10days)
April 2016 (8 days)
june 2016 (10 days)
Oct 2016 ( 10days)
Feb 2017(11 days)
june 2017(10days)
DEC 2017(10 days)
no absence after that

applied extension on 07/07/2018
received biometric cards till 29 /08/2020

sir i am very confused when to apply ILR as i saw in policy that they will use back counting procedure for calculating number of days.so by back counting method what will be mine eligible period for ILR .
i cant use the visa stamp date for my start point so which date should i use please help me on this issue .

Apply on 18/05/2020 and you should be fine

Thank you Zimba for the reply.

will I be safe if I apply in July 2020 as I cant have the life in Uk test now a days due to pandemic. as per back counting procedure eligible period will be from july 2020 to july 2015. but in july 2015 I was not in UK .

I have one more query regarding the job creation as I am new to this forum so don't know about the rules of the topic postings .

I have three employees in total

1. Mr A joined : 01/04/2019
130 hours /month till 31/03/2020 (complete one year)

2. Mr B joined : 01/04/2019
130 hours/month till 31/08/2019 ( 5 months)
120 hours / month from 01/09/2019 till 31/03/2020 ( 7 months)
so Mr B also employed for a year but 5 months full time and 7 months part time .

3. Mr C joined :01/04/2019
80 hours / month till 31/03/2020 ( one year complete )

from 01/04/2020 all of them are furloughed.

my question is can i join mr b and mr c in a job to make full time for the rest of 7 month period as mr b have done full time for 5 months and after that he has done part time.


i will be obliged if you can help me

You can apply in July. As far as I know, you cannot combine full time roles with part time roles. Only part time roles that existed for 12 months can be combined together

So how about the new rules which comes under effect due to corona virus. As below

The Home Office has announced concessions for Tier 1 Entrepreneurs whose businesses have been affected by the COVID-19 pandemic.

You will no longer be required to employ at least 2 people for 12 consecutive months each. The 12 month period you are required to employ someone for can be made up of multiple employees across different months.

If you have not been able to employ staff for 12 months in total by the time your visa expires, you will be allowed to temporarily extend your stay to give you time to meet the requirement.

It should be noted the time when your employees were furloughed, will not count towards the 12 month period.

I am not sure otherwise they would have not allowed you to extend to meet the requirement. Your visa expires in 29/08/2020
