T1E Continous Leave calculation

Post by mohamedlasheen » Tue Apr 21, 2020 1:15 pm

Dear All,

I have switched from T2 Sponsored to T1E last year
T1E granted from 15 July 2019 to 15 July 2022
unfortunately I was not able to be in the UK since 15 July 2019 15 January 2020 for long time, I am afraid that the year of 2019 will have an impact of the 180 days absence allowed.
as per the time frame, I can apply for extension on 15 July 2022 for two years ending 15 July 2024
As far as I know that the last to apply for ILR is 5 April 2025, is it possible to apply for further extension from 15 July 2024 to 5 April 2025, so as to calculate the 5 years continuous leave without the need to include the long absence in 2019?.
Please advise.

No. Extension applications for Tier 1 (Entrepreneur) migrants will remain open until 5 April 2023, and settlement applications until 5 April 2025. It is your responsibility to ensure you can apply for extension or ILR within that time frame. If you were out of the UK for more than 180 days, then your continuous period is broken. I suggest to apply for another extension around 5 April 2023 to enable you to apply for ILR by April 2025.

Thanks Zimba for you response, I will summarize what I understood below:

1. I can apply for the normal extension before the current leave ends i.e. before 15 July 2022, if acceptable; I will be granted further 2 years i.e. until 15 July 2024.
2.To gain more extension, I can reapply for further extension before the dead line i.e. before 5 April 2023, if acceptable I will be granted an extra period say until 5 April 2025
3. Before 5 April 2025, I can apply for ILR and claim the best 5 years back dated i.e. neglecting 2019 totally and considering only 2020, 2021, 2022, 2023 and 2024.

Is that correct?,

Also, I just have a question, As per your experience with many cases in the forum, is that is it possible/common to apply for extending the visa twice before applying for ILR? as that is new to me.

Thank you very much for your support.
