Scenario: The Employee has completed 5 years of work in the UK across two Tier 2 (General) Visas, with his current leave expiring in April 2021. He wishes to apply for his ILR application as soon as possible, however, there has not yet been published any relaxation or legal guidelines of the ILR Rules in terms of the required minimum salary to qualify and how any reduction in salary due to the furlough scheme would impact an ILR application.
Query: If an employee is under furlough and the employer tops-up the salary to 100%:
a) With above in mind, since 80% of the salary is paid via the Furlough scheme and not the employer directly, will this still satisfy the minimum salary requirements for the Employee's future ILR application?
b) Does the duration of the furlough impact the Employe’s future ILR application in terms of qualifying requirements?
