Naturalisation and expired B1 Trinity

Post by Jayrose17 » Fri May 29, 2020 9:30 am

Please help
I applied for naturalisation end Dec 2019. I recieved my ILR one year earlier and used a valid B1 Trinity college during ILR application
I recieved an e mail from home office saying my B1 expired.
I am sure I read correctly that you may use the same B1 you used for settlement/ indefinate leave to remain.
Can someone assure me and clarify.
I have till June the 10th to send my cert but all colleges are closed.
I replied to the case worker with the information I have regards this.
Thanks for help in advance

In your application did you select the option stating you provided the English test with your ILR application in 2018 (which is the requirement)?
In your feedback to the caseworker you need to explain this.
This is just my opinion as a member of this forum and does not constitute immigration advice.

I will try go and look at this. Surely the requirement to get ILR is life in the UK test and English B1 unless your country is recognised English speaking first language and South Africa is not.
I would not have been able to apply for naturalisation without a year of ILR.
One leads to another. It's almost like saying provide your grand mothers birth certificate for my original ancestral visa.
Does not add up.
Thanks I will look at my application.
I clearly to give my SELT number in my application as this was a requirement. Both in my ILR and naturalisation application.
Cheers

Oh dear
I just picked up my mistake on the application. Your question was spot on .
Page 10 of 11 asks if you did the English language test for any previous applications. I answered no when it should have been yes as I used it a year previously for my ILR.
I have e mailed the case worker and explained my error in answering no instead of yes.
I hope I will get some leniency in the application.
It was a honest but stupid mistake.
How could I gave said no when I required it with my knowledge of the UK test to acquire my ILR.
I JUST PRAY THEY ACCEPT MY APOLOGIES AND RECTIFY MY MISTAKE.

We all make mistakes at some time or other.
If you clearly explained to UKVI what the position is there should not be an issue.

Naturalisation application ( ILR granted under leave outside the rules???

Post by Jayrose17 » Fri May 29, 2020 5:54 pm

Conundrum??
I applied for Naturalisation end of Dec 19.
I recieved an e mail from my case worker stating B1 was outdated.
I supplied this for my ILR a year previously and was granted.
I queried this?? Recieved e mail back saying my ILR was cos considered under ' Leave outside the rule'
WHAT ON EARTH IS THIS???
I followed the standard ancestral visa to ILR to Naturalisation route.
All in time 5 years then 1 year ILR then my naturalisation application.
Why would the case worker state my ILR was not considered under normal route and my B1 was not checked at the time?
Please help my confusion.
Thank you

Topics merged!!! Please desist from starting new topics asking the same question.

You have already been advised to simply reply to ho and explain, even listing your visa route to ilr. The letter is likely an error in stating your route.

Apologies for the different posts as the circumstances changed.
I recieved one e mail stating my B1 was not valid.
I replied as advised above where I did pick up I said no instead of yes when asked if I had used my B1 for any other application.
I subsequently only recieved another e mail this afternoon back stating my ILR was considered LEAVE OUTSIDE THE RULES. therefore my B1 was not checked at my ILR application.
All my applications were all stock standard stuff and nothing outside of any rules..
So therefore my confusion as to why I was told this and non acceptance of my B1 which clearly was required and supplied for my successful ILR application.
I have e mailed the case worker back querying why they believe i was given my ILR outside the rules and that's why my Trinity B1 Is not valid.
I hope someone can shed light on this LEAVE outside the rules reason.
Till today I had never heard of the phrase.
Keep well.

What does your ilr approval letter state, word for word?

To the tune of my indefinate leave to remain has been approved. I will receive my brp in the post.
It said later I have no restrictions etc and talks about if I leave the country.
My BRP States Residence permit on top and factory at bottom. Indefinate leavevto remain.
I have no other letter stating otherwise??

Pleased to provide info that my caseworker consulted a senior caseworker and confirmed that My Trinity B1 was valid due to being accepted a year previously in my ILR application. Lost £100 though booking a new B1.
You live and you learn. I should have thoroughly investigated the issue with home office first. Fear of being refused my naturalisation took over before I
looked up the relavant legislation on this.
I wonder how many people have been in the same boat and actually re did their B1 exam.
I accept we all human and do make mistakes so Here's hoping the rest of my application is viewed favourably and I'm granted my naturalisation asap.
Thanks for this forum.
It relieves alot of anxiety at times regards immigration matters.
