Tier 4 visa Eligibility

Hi,
I need some advice for my situation to get tier 4 visa.
I am currently living in uk under pbs dependent visa.
I finished my PG in 2013 in india and worked for 2 years in india until 2015.
Later i took a break (due to marriage, moved to uk as dependent and concieved a baby) and have been idle until 2018.
I joined as sales assistant in 2018 then and currently working in the same job.
Due to the recent tier 4 visa changes, i wish to continue my education and do a PG degree in uk.
Can someone please let me know what are my chances of tier 4 visa?
Will the gap in my career (2015-18) is going to impact my chances of getting the tier 4 visa.
Can someone please guide me with my situation?

Is the person you are the dependant of not extending their own visa, and you with it as their dependant?

No, My husband is on tier 2 ict visa which expires in another 1 Year or so (5 years overall) . No further extension possible as there is a mandatory cooling off period for 1 Year. Do you suggest studying with dependent visa itself? Is that even possible in my case?

A dependant visa has no restriction or prohibition on study, but if your visa ends before your course ends, you will still need to leave the UK and apply for a Tier 4 visa in your home country.

Thanks a lot for the Reply. My visa might probably end before my study finishes hence i am planning to change from PBS dependent to Tier 4 visa before the course begins. My only concern is about, the gap i had in my career, would it affect my credibility in getting Tier 4 visa ? is there any risk of visa refusal in my case ?

Switch from Tier 2 ICT Dependent to Tier 4

Hi,

I got an offer to apply for PG course in UK University for the September 2020 intake. I am currently in UK as Tier2 ICT Dependent.In general, I should go to my Home country to make a Tier-4 Application. But, under the current Covid-19 Situation, Travel is bit uncertain now. Is there any possibility / Guidance released from government to make application from UK itself without travelling to home country?

Could anyone please help?

Thanks for providing the link. The link specifies, the switch can be done for the applicants whose visa expires before July 31st. This is the case with me and my visa expires by next year. could anyone please advice my options in my case ?

Again, the concession to apply in the UK is only for people with leave that ends on or before 31 July 2020.

What is the rush? Start the course with your current visa, which is valid for another year yet. When it is possible and convenient to travel, perhaps over the Christmas or Easter vacation, go home and apply for a Tier 4 visa,

Thanks for the reply. I don't want to rely on the dependent visa to pursue my studies as in this current job market, if we happen to leave, I need to break my studies to return immediately to apply for tier 4 visa.
If my tier 4 visa gets rejected/delayed for some reason at that time , it would put my studies in dire risk.
So, i would prefer to get Tier 4 visa first and then start my studies. so, hoping to find a way to apply for Tier 4 visa (if possible in uk itself). Please provide me any viable options in this case.

Hence my advice to do it over the Christmas break, travel restrictions permitting.

When normal service is resumed, rejections and delays will normally only happen due to applicants' own errors in the application, not for reasons beyond their control.

There are no options for you do that. The only way you could apply in the UK is if the current switching concessions are further extended to include people whose leave is ending in June 2021, which seems very unlikely.

Does that mean Tier 2 Visa Dependents can switch to Tier 4 within UK Itself even the visa expiry date is after July 31st ? Please confirm.

That is exactly my understanding as well - "you can apply for a Tier4 student visa for courses starting in Sep/Oct 2020 within UK even if your current leave expires after 31st July 2020."

Can an expert validate this understanding?

It depends how urgent it is. See https://www.gov.uk/guidance/coronavirus ... -residents

If you’re applying to stay in the UK long-term

You can apply from the UK to switch to a long-term UK visa until 31 July 2020 if your leave expires between 24 January 2020 and 31 July 2020. This includes applications where you would usually need to apply for a visa from your home country.

You can also apply from the UK if your leave expires after 31 July 2020 but you urgently need to make a new application, for example to start a new job or course of study, and cannot leave the UK to make an application from overseas. This includes applications to switch into a different work route or to change jobs in the same route using a new Certificate of Sponsorship (CoS).

You’ll need to meet the requirements of the route you’re applying for and pay the UK application fee.

This includes those whose leave has already been extended to 31 July 2020.

You can apply online. The terms of your leave will remain the same until your application is decided.

I would advise waiting until it is without any question "urgent", i.e. very shortly before the start of your new course. If meanwhile it becomes possible to travel to your home country, you can then do so and apply in the normal way without needing to rely on a vague concession that you may not meet.

I could wait until my course nearing date to apply but i have seen that this concession is only applicable
for applications making before July 31st ? so, i may loose this previlage if i delay application process as well.
can someone please suggest for he best option before me ?

I advise waiting until after that date. It seems highly likely to be extended, but on the chance that it is not extended, that is the Home Office saying you can apply in your home country, and hence you would not meet the concession anyway.

See my previous reply Wed Jul 08, 2020 2:59 pm for details of the concession which allows some people to apply in the UK when they cannot normally do so. Or if you want one-to-one advice, speak to the international student adviser at your university.
