Post by Leo_one » Mon Jun 08, 2020 4:24 am

Hi please guide me. My son age is 22 non EU national got settled status last year and it was mentioned in letter he can apply for nationality after12 months which will be completed in April this year but his total period of stay in UK is 3 year. Can he apply for nationality? I have read for nationality you have to complete 5 years but somewhere I have seen after 3 years if you have permanent residence or ILR. Please if anyone have idea. No he can't apply yet. An applicant who is over 18 requires 5 years residence before they can apply for citizenship on form AN.

Yes, he needs 5 years residence. The 3 years residence rule applies to a spouse of a British citizen ONLY.

Your son needs both ILR/PR/Settled Status AND five years of residence in the UK (if not married to a British citizen). The three year requirements only apply if he is married to a British citizen.

There is also a non-negotiable, mandatory, requirement that he needs to have been physically present in the UK exactly five years (or three years if married to a British citizen) before the date of the naturalisation application.

There are also limits on the amount of absences from the UK in both the five/three and one year periods immediately preceding the date of naturalisation application, as well as other (good character, LITUK test, English knowledge, etc) requirements.

All these conditions must be met for the application to succeed.
