Spouse extension visa English requirements

Hi All.

My spouse came in on a 2.5 yr spouse visa (I am a UK citizen).

She sat the IELTS test in India when she originally applied.

Can someone tell me if she can use same IELTS test certificate from previously to apply with for the spouse extension visa. I keep hearing A1, A2 etc but not sure where this information is.

Would kindly appreciate any help.

A1 is required for an initial spouse visa.

A2 is required for an extension of a spouse visa.

B1 is required for ILR.

if my spouse is confident, could they apply to B1 instead so it is in place for when she comes in to apply for ILR.

I am guessing certificate will expire though? just want to try and save money if possible

Yes B1 is acceptable.

An expired text can be used if it was used in a previous application AND is still from a test provider on HOs list.

where is the guidance on the expired test from previous application written. I have searched for this. When she wrote IELTS previously for initial spouse visa, it was at B1.

Could you please provide a link for HOs list too please.

One final question, where does it say B1 can be sat for spouse visa extension and also what score do you actually need to get in speaking and listening for visa extension to be granted

Was it B1. If so then you maynot need to redo it as it will be accepted under paragraph 32D.

Just checked, she actually wrote IELTS academic for the first visa and it was accepted????

If that test was "IELTS FOR UKVI" with ukvi reference number on it with CEFR level of at least A2/B1 then it would be accepted again.
Please note that both General and Academic Training modules are accepted. The CEFR requirement for each skill must be met.

IELTS for UKVI can be used where IELTS Life Skills is used; test takers would need to get 4.0 or above in Speaking and Listening (scores for Reading and Writing will be ignored).

thanks but the bit you have highlighted in yellow the challenge is, the test centre is not matching with the links provided in that HO list??

Ask discretion under paragraph 32D:
32D. If an applicant applying for limited leave to enter or remain under Part 8 or Appendix FM submits an English language test certificate or result and the Home Office has already accepted it as part of a successful previous partner or parent application (but not where the application was refused, even if on grounds other than the English language requirement), the decision-maker will accept that certificate or result as valid if it is:
(a) from a provider which is no longer approved, or
(b) from a provider who remains approved but the test the applicant has taken with that provider is no longer approved, or
(c) from a test centre which is no longer approved, or
(d) past its validity date (if a validity date is required), provided that it is at or above the requisite level of the Common European Framework of Reference for Languages and when the subsequent application is made:

When to start spouse visa extension process

Hi Guys,

Please could someone tell me when the spouse visa extension can be applied for. Is it 28 days before expiry. I can't find much on it.

Also how can I work out when this 28 day period (if it is) will be. Is the date of expiry on BRP card?

Yes , you can apply 28 days before date of expiry. 28 days before Date on the Bio-Metric Card to be precise.

The extension can be applied for within the period of 28 days from completion of 30months/2.5yrs stay in the UK till the date of expiry stated on the BRP.
You calculate your 30months/2.5yrs in the UK from the date of entry in UK with your spousal vignette.
