I got refusal on court of appeal and she is dependent on me so she also got refusal as well and both 3c come to end , But she has just 2 month left to eligible for 10 year route ,

Residence for ilr is broken once section 3c ends.

If HO have detected some tax discrepancy which wasn't attempted to declare/fixed earlier then it would now be deemed as deception with zero tolerance/discretion.
Maybe varying into 1 year of free extension might temporarily work and you may become her dependant. But her 10 years of legal residence must have been broken where she obtained the visa by being your dependant during the time where your tax record wasn't accurate.
