ILR when you submit online application

Hi,

I need to apply for my ILR in the coming months. I’m aware of the 28 days rule prior to the end of the 5 yr period. My 5 yr period is the 4th of august which makes the 28 day rule the 7th of July.

Is it possible to put in an application online before the 7th and book biometrics on or after the 7th? Will that be permissible ?

Apply, Cancel and Reapply

Hi,

I’m wondering if any of the mods can give advice on my strategy below.

Given all the uncertainty regarding appointment times and the resumption of normal services, I’m hoping to give myself more of chance of getting a decision made faster by doing the following:

- Apply now with standard service given the uncertainty.
- If I’ve not provided biometrics by the resumption of priority services, cancel application and make new one with super priority service.

I have my visa valid until end of November.

Does the above make sense? Will i suffer from it? Can HO refuse to refund my original application ?

That acrobatic exercise might only work if UKVI caseworker doesn't send an email asking to supply your supporting documents even before the UKVCAS appointment.

Also withdrawing an application renders an applicant an overstayer if they are under section 3C. As repeated, priority service may not return anytime soon

Ha! I guess I thought I was being clever. I guess I’m loathe to join such a lengthy queue that is the standard service but it’s preferable to waiting for an unknown event that is the resumption of priority services.

Variation of Leave

Hi Mods,

I’m in a peculiar situation as I’d be eligible for ILR on the 7th of July and I have a job offer with a different employer.

I’m trying to accelerate my start date with my new employer as I’m not sure when my ILR application might get sorted given the current situation with covid.

My new employer might be able to sponsor me and given the covid provisions, my understanding is that I can apply for a tier 2 and start as long as I’ve lodged my application. Is this correct?

Further more, given my ILR eligibility, would I then be able to vary to an ILR application (without waiting for the complete processing for the tier 2)?

So I can vary using a letter of employment from the new employer even though the tier 2 visa I’ll be obtaining using them as a sponsor will not have been approved yet?

I thought we can only submit the application when we qualify So my understanding is that you can only apply after the 7th and the appointment date doesn't matter. Do let me know if my understanding is incorrect.

I think I can technically apply now but I have to make sure my biometrics is beyond the 7th. I'm personally choosing to apply on/after the 7th.

Hi,

I decided to apply last Thursday since I checked the guidance and seems I can apply even though I’m only eligible from tomorrow 07/ July.

Question is this - my most recent is dated 26/June and I was going to use the auto generated one but I’ve requested a stamped one from my company which might have a date on it . Let’s assume it has a stamp date of 08/ July. The actual pay will be clearly marked as for 26/ June too.

Also my bank statement has my incoming pay for 26/June although the date header on it says from 05/June to 04/July.

The highlighted dates are after my application date, clearly. Is this problematic? Should I cancel and reapply?

UKVCAS Refunds

Hi all,
In the madness of the last week, I cancelled appointments I paid for a couple of times and rebooked. Can I expect to get refunds on the amount paid? Does UKVCAS do refunds?
