Tier 1 General -dependent- (Urgent advice please)

Post by salim » Sat Aug 23, 2008 9:26 am

Iam currently on work permit visa valid until 30/08/2008,I have applied for tier1 general in 27/07/2008.My wife is on a work permit visa dependent on me and her visa is valid until 31/08/2008 .I was not able to apply for her as Tier 1 general dependent because my bank account dropped below 1333 pounds for 2 weeks in June 2008 when went for a holiday but my account has been more than 2500 since 25/06/2008 so I will be able to apply for her in 25/09/2008 when the maintenance fund will be in my account for 3 months.the problem now is that her visa will expire in 30/08/2008 and I don't know whether I can apply for her now or not and if i did ,will that affect my application as a main applicant.what are the options that we have for her to stay in the country legally if any ? and if she went back home how can I apply for her ? could you please advice ?
many thanks

If you cannot show evidence of maintenance funds until 25/09, then there is no question of making a dependent application before that.

Your spouse will need to return to home country before her current leave expires and make an EC application as a Tier 1 dependent (after your Tier 1 is approved).

thank you sushdmehta.

Has any noticed the Transitional arrangements for Tier 1 (Entrepreneurs) regarding the Funs It says :

Because this is a new requirement and it may be difficult to prove this immediately, we have put transitional arrangements in place for you and your family members submitting your applications within the United Kingdom up to and including 31 October 2008.

Up to 31 October 2008, you do not have to show you have had the funds for at least three months before your application. You must only show you have the required funds at the time you apply. Until 31 October 2008, your supporting evidence does not need to cover the three-month period, but the documents must be dated no more than a month before your application.

Does any one know if there is such a thing for Tier 1 general ??

You are two months too late!

Similar transitional arrangements were in place for in-country Tier 1 (General) applicants who applied between 29-Feb and 29-Jun.

I'm afraid NO (see Sushdmehta's post above). That means: transitional arrangements for Tier 1 ended 30 June 2008.

Hope this helps.
