Extend my Tier 2 General Visa after 6 years

Post by Mr AAL » Thu Jul 23, 2020 4:52 am

Hello everyone,
I shall complete my 10 years continues residence on August this year. My 1st employer was not able to pay me salary due to business fallout for few months, then closed the business in 2015, then I have switched to 2nd employer without any curtailment letter. Is there any possibility that my ILR set lr application can be refused because non paid tax from first employer?
Other than this issue my immigration history is clean.

If there is any possibility to get refused for ILR under 10 years route, can I apply for extend my Tier 2 General visa?

Please help!

Regards

Set LR doesnt have an employment requirment.

You cannot hold a tier 2 general for more than 6 years.

When does your tier 2 visa expire?

Hi CR001,
Thank you for your kind reply.
I arrived in UK on 15 of September 2010. And I am on Tier 2 General Visa since 1 October 2014. my current Tier 2 General Visa will expire on 31st August 2020.

Can I continue work with current employer after my ILR SET LR application? And if visa refused for any unexpected reason, can I extend my Tier 2 General Visa?

I appreciate your time.

Kind regards

Yes, you can work for anyone. You will have to update your employer with your immigration status and ILR BRP.
And if visa refused for any unexpected reason, can I extend my Tier 2 General Visa?
No.

ILR set LR question

Post by Mr AAL » Sun Aug 09, 2020 5:30 am

Hello there,
I arrived in the UK on 10 September 2010 under tier 4 student visa.
Switched to PSW from October 2012 to October 2014.

Then switched to tier 2 general visa for 5 years on October 2014 to October 2019.
1st Sponsor paid salary for October, November, December only, because business was down and couldn’t continue pay me salary and eventually company dissolved in June 2015.

Please note, I have never received any curtailment letter.

Meanwhile I had another job offer in February 2015, and applied for tier 2 visa in June 2015. And visa was granted from 20 august 2015 to 21 august 2020.

Now, I am about to apply for ILR Set LR 10 years lawful resident route.

My question is, because I wasn’t in payee for 8 months with the 1st sponsor, will it affect badly for my ILR application? If yes, what is the solution?

Please help me by answering your opinion, I’m very stressful because of this unpaid salary.

Kind regards,

It probably means that at some point in the past, you got flag for curtailment of visa or leave but when checks were carried out, you were found to be compliant/not breached any rule and they left you alone.

Hello there,
Thank you for taking time to answer me.

I have another question, what should I write for the question in the application form for Question: do you have any other reasons for wanting to stay in the UK?

Just to let you know, I am separated from my partner (NOT divorced yet) but I have bought house, car, business and social connections and lots of friends over the last 10 years. Going back to my home country will not just easy for me in this stage.

ILR SET LR Questions

Post by Mr AAL » Tue Aug 18, 2020 6:39 am

Hello there,
I am about to submit my ILR SET LR (10 years long residence route) application. Could you please help me answering following 2 questions?

I have arrived in the UK on September 2010 and currently under Tier 2 General Visa since September 2015.

1. Do I need employers letter for absent from UK and a letter for proof of current salary and job offer after getting ILR approved?

2. My starting salary was GBP 29000. I had a pay raise in July 2018 for GBP 37000 which has not been informed to Home Office via SMS system by my current employer, will it affect my ILR application?

I appreciate your time to answer above questions.
Kind regards,

1. No

2. Irrelevant. You are NOT applying for ilr based in tier 2

Hello there, I have qualified to submit my application for ILR within 28 days of my current visa expires.

Question: If I submit my application and pay fees anytime now via online, will it be my application date? Or application date will be considered on biometric date?

I think I can not find a biometric date in UKVCAS within 31 August 2020 is the date of my current visa will be expired. What to do in this case?

Please help.

Date of application is the date you submit and pay online and not the biometric appointment date.

You must apply before your visa expires. Your existing visa conditions will continue under section 3C of the immigration rules while your application is pending with ukvi.

As set LR has no income requirement but maintaining veracity most importantly is desirable, therefore, for remaining be shielded under all scenarios I will declare both incomes even via covering letter.

Thank you seagul,

I have submitted my ILR application, appreciate for all your kind informations and supports.

Now, I have to provide 4 mandatory documents,
1. Current Passport
2. Current BRP
3. All Previous Passports
4. Documents supporting my other reasons to stay in the UK

I left a note of other reasons for wanting to stay in the UK, that I have personal and professional ties in the UK since last 10 years, but I have no documents to support that. Because its a mandatory document, if I don't provide, how it affect my ILR application? and how can I resolve this issue.

Please let me know.

You have to upload your documents before biometric appointment.

The date of application is the date you submit and pay online and NOT the date you upload documents or your biomteric appointment.
