Ilr Qualifying period

Hi Moderators
I switched from Tier 2 ICT (issued during Feb 2011) to Tier 2 General in Oct 2015, via in-country switching as the old Tier 2 ICT visa category allowed to do so.

Tier 2 General BRP Issue Date: 29-Oct-2015
Tier 2 General Valid Until - 26-11-2020
Previous Employeer Last Date (Tier 2 ICT): 20th Nov 2015
New Company Joining Date: 26th Nov 2015

While i was serving notice period with old Tier 2 ICT employeer, i went to india on 15th Nov 2015 and returned back on 25th Nov.

1. I understand my earliest eligibility date for online application submission is 3rd Oct 2015. Is this correct?

2. Do i need to provide any proofs for the absence i had with my previous Tier 2 ICT employeer as my current employer wont be able to provide any letter of absence for that period?

correction for point 1: i meant earliest eligibility date for online application is 3rd Oct 2020. :)

1. Yes, 28 days before the 5th anniversary of your initial tier 2 general visa issue date.

Hi Moderators,
Im in the filling the ILR application online. My situation is as below

I came to uk on a Tier 2 ICT Established Staff visa on 9th Oct 2014. This visa allowed me to switch to tier 2 General in-country (without leaving UK ) as this visa was issued under regulations Pre-april 2011.

I switched to Tier 2 general in Oct 2015, BRP issue date is 29th Oct 2015. Before joining my new employer under the Tier 2 visa, i was briefly out of country from 15th Nov to 25th Nov 2015.

There is a question in the application form about "When did you first enter the UK?".

What is the date i should mention here based on my above situation? is it 9th Oct 2014 (under Tier 2 ICT Established Staff) or 25th Nov 2015 (under Tier 2 General).

Both dates can be given but ideally rely on that date which corresponds to the visa making you qualified for ILR which in your case is tier 2 general.

Further question about my ILR application and UK born son's eligibility.

My son was born in the UK after i got tier 2 general visa. His Tier 2 Dependent visa expires same as mine on 26th Nov 2020. I and my wife are applying for ILR on 2nd Oct, but my son wont be completing 5 years in the tier 2 general visa at that time. As per the gov.uk guidelines i read, he will be eligible to apply citizenship as soon as i get ILR. So we are not applying for ILR for him in our application.

the question is if i dont get the ILR by 26th Nov 2020,

a) will he be required to apply for ILR ?
b) if not, will he be required to apply Tier 2 dependent extension to continue staying in the country?
c) if not, Can he just apply for citizenship once we get ILR, without worrying about his visa expiry?

A UK born child does NOT need ILR or a valid visa to apply to register as British. They have an entitlement to register, ie cannot be refused.
