ILR application and home fee status

I am living in the UK in the tier 2 with my department son and we both qualify for applying ILR. Before coming to UK I and my son were living in an EU country for three years. My son has an unconditional offer to study medicine in the UK and he is classified as international student for fee purposes.
I was hoping to obtain my ILR status before the start of the course, but due to the pandemic related closure of the UKVI, I could only submit my ILR application this week. Although priority services would have allowed me to get the decision in 1-5 days, priority and super-priority services are also remain suspended at this moment. I will be able to get the ILR status probably in September - December 2020 as my application is straight forward and there is no issues.
I wonder whether my son will be able to qualify for home fee status if he defers the entry to next year? any other option?

I am not knowledgeable on this, but when my dependant daughter was applying to college, I recollect that the criteria (re home or overseas fees status) was based on how many years she had been living in the UK (as opposed to her actual visa status). I would suggest checking the criteria with your son's proposed university.

There are several categories but this one applies to your son:
In order to qualify for 'home' fees under this category, you must meet all of the following criteria:

(a) you must be settled in the UK on the first day of the first academic year of the course; and

(b) you must be ordinarily resident in the UK on the first day of the first academic year of the course; and

(c) you must also have been ordinarily resident in the UK and Islands for the full three year period before the first day of the first academic year of the course, for example, if your course begins in October 2018 you must have been ordinarily resident in the UK and Islands from 1 September 2015 to 31 August 2018; and

(d) the main purpose for your residence in the UK and Islands must not have been to receive full-time education during any part of that three-year period.

Note: It is not necessary to have had settled immigration status in the UK for the full three years. You only need to show that you have it on, at the latest, the first day of the first academic year of the course.
