HSMP dependant - won't be settled in UK

HSMP dependant - won't be settled in UK

Just a quick question, will an HSMP dependant have a problem when applying for an extension or ILR if he's not 'settled' in the UK?

He hopes to be 'visiting' his wife here in the UK as often as possible due to the nature of his work.

Unless you have ILR, you do not have "settled" status in UK. What you meant to say was " resident" or "ordinarily resident".

Living together seems to be an important part of the whole deal (not just for extension, but a promise made when applying for entry as well) - if on HSMP, read para 196(A)(iv), 194(ii) and if on Tier 1, read 319C(e) of the Immigration rules

Living in different cities in the UK because of professional committments can still be justified (weekly home visits) but living in different countries is a different ballgame altogether, I think.
