Hello
I have been on Tier 2 General for 5 years and could not apply for ILR as there was no priority service and currently switching sponsors, I need to extend my visa for one year and will apply immediately after getting the new visa but my new employer gave me a COS with work dates from 2/9/2020- 1/9/2023 should this be a problem Or the Home office will give me a visa for one year anyway ?

You will need at least one payslips from your new employer before you can apply for ILR.
I need to extend my visa for one year and will apply immediately after getting the new visa but my new employer gave me a COS with work dates from 2/9/2020- 1/9/2023 should this be a problem Or the Home office will give me a visa for one year anyway ?
HO will only issue you a visa to take you up to a maximum of 6 years in total. So yes, you will only get a 1 year extension. The employer only needed to issue a CoS for 1 year. As it is a 3 year CoS, you will need to pay IHS for 3 years.

Note that priority service is still suspended and not available.

May I ask another question,
After checking the CoS, there have been few (Minor) mistakes which were all corrected as a note which was added to the CoS.

These mistakes were as follow:

Country of residency
Passport issue date
Place of issue of Passport
Total weekly hours of work

Otherwise its the Right Tier and Right Category, No significant errors that may require cancellation,

Do they need to cancel it and to issue a new one ?

Hello

Please may I double check, I’ve just been issued a CoS from a new employer and After checking it there have been few (Minor) mistakes which were all corrected as a note which was added to the CoS.

These mistakes were as follow:

Country of residency
Passport issue date
Place of issue of Passport
Total weekly hours of work

Otherwise its the Right Tier and Right Category with no other significant errors eg : Surname , DOB or Nationality,

Please could you advice whether they need to cancel it and to issue a new one giving the number of minor errors or should this be OK ? HR said they don’t need to cancel it.

As long as the fields that are being changed are not involved in the issuance of cos it’s fine.
Basically these fields are filled after cos is issued so you’d be ok.

Salary and working hours are mentioned while applying for COS so I think your company would have to apply for a new COS.
Each COS is accepted against the score of the occupation if you make any changes to job then COS needs to be reissued.
You can check COS guidelines for sponsors on gov.uk website
Your personal details and work start and work end date can be amended in sponsor notes

Any other suggestions please, I am a bit confused now as working hours is not mentioned as a “Significant error” in government guidelines Page 7.

it was only changed from 34 to 37.5 , so technically even 34 hours is accepted, Salary was Fine,
My concern is the number of Minor errors (4) but all corrected in Sponsor Note, would that be enough ?

Sorry as it might be a silly question but just wanted to make sure that I am doing the right thing,

I am on Tier 2 General visa and I was planning to apply for ILR in June so I part completed a SET O application but it was not submitted, However my situation changed and I have to switch sponsors before applying for ILR,

My question is it OK to fill a new application to extend my Tier 2 visa while I have a part completed SET O application especially that there is no option to cancel it ?

I always found your answers simple and precise,

Please could you advise regarding the mistake in CoS, especially the total weekly hours of work, they changed it from 34 to 37.5 by adding a sponsor note and the Salary is correct and is much higher than threshold anyway,
Is a sponsor note sufficient to correct this ?

My employer is going to issue a CoS with work start date from tomorrow 2/9/2020, is this OK if I applied for the Visa today ?

You can either apply today or they can amend your start date in the sponsor notes and postpone it by a few weeks if it works and that can give you time to submit application.

I will apply today and I think I’ll be able to start working from tomorrow while waiting a decision of my application, just wanted to check that there is no period limitation between Date of application and work start date :shock:

Hello
I applied online about a month ago for an extension of my tier 2 general visa (change of employment) and submitted my biometrics with UKVCAS few days ago,
working hours on CoS were 37.5 which I put on my application, however HR team now think my working hours are actually 33 hours/week with no change to salary.

I am not sure what should I do as now I am awaiting decision re an application which is in process ??do I need to report this change ?
