6 Weeks outside the state- Do travelling days count?

Post by brit_in_dublin » Wed Sep 09, 2020 5:16 pm

Hi,

I'm a British citizen looking to apply for my Citizenship. Been resident since Sept 2013. However, the 6 week rule in the preceeding 365 days before application is difficult to achive. - I'm assuming this 6 week rule does apply for EU/UK citizens?

I have a couple questions and if anyone has any advice based on their own experience/knowledge I'd appreciate your advice.
  1. If I take a holiday from 1/02/2020 (the days of my flight) - 7/02.2020 (the day i step foot back in the state) does this count as 7 days absense or 5 days (where the days of travel are not counted).
  2. Are work trips counted within this 6 weeks? - is any leaniance given if I'm 2-5 days over?
Thanks you so much in advance.

I can only answer your first question as I asked the same thing and got an answer from INIS in the past.

Here is their reply:
"A reasonable and generous period of 6 weeks is allowed to provide for
absences for normal holidays and other short absences such as for a family
bereavement.

Absences totalling 6 weeks or more in any year will be deducted in total
when calculating your residency.

The day you leave and the day you return will not be counted as a days
absence.
"

Hope it helps

What does it mean:
"""
Absences totalling 6 weeks or more in any year will be deducted in total
when calculating your residency.
"""

If I was out for 49 days during the year. Since it is more than 6 weeks (42 days) hence it will deducted from residency calculating.
What exactly will be deducted all 49 days or just difference 49 - 42 = 7 days?

Another question, can you please point to the INIS website where this is stated that I allowed be out of the country for more than 6 weeks?

Thank you in advance.
