Can anyone please let me know under which category should we upload the Declaration and consent form.

I have checked the pinned topic regarding document upload, however there is nothing mentioned about the consent forms.

TIA

It does not have to be specifically under a particular category. You can upload under 'others', just ensure they are uploaded.

Just upload the current passport in “proof of application.”
Any other passport can be uploaded elsewhere.

@CULLINAN once i have booked an appointment, how can i know if there are earlier appointments available?

If i press cancel appointment, will the current appointment get cancelled before booking an appointment.

Thanks

Yes. If you cancel, you will be at mercy of any new availability at that point in time.

A quick query. Does the Declaration and Consent Form need to be dated after the application date?

Thanks

I have uploaded & submitted declaration and consent dated one day before application submission. Should i upload a new one dated on/after the application date and ask ukvcas to submit those during biometrics? Is it fine if it is uploaded within 24 hours of biometrics?

Re: ILR Dependant

Post by piqueblinder » Mon Oct 12, 2020 2:51 pm

My spouse received ILR on Tier 2 General Main Applicant earlier this month.

I am on PBS dependent visa since 26/11/2015. However this is valid till 21/10/2020.
I become eligible for ILR on 30/10/2020.

So wondering if I can apply on 19th October and book a biometric appointment after 30 October?

Also I believe I need to fill the SET(O) form to apply for ILR as PBS dependent?

Thanks

Pay and submit when you qualify. Date of application is date when you pay and submit. Biometrics date is irrelevant.
SET(O).

I wont qualify until 30/10/2020 and the Tier 2 dependent visa is valid till 21/10/2020.
I am falling short by 10 days.

What is the correct process in this case?

Thanks

In that case yes. Apply on 20/10 (before expiry), book an appointment after 30/10. Since a decision can not be made without biometrics, CW should take date of decision to calculate your continuous residency. Also add this guidance in the cover letter.
Calculating the specified continuous period
Applicants can submit a settlement application up to 28 days before they would reach the end of the specified period.
You must calculate the relevant qualifying period by counting backward from whichever of the following is most beneficial to the applicant:
• the date of application
the date of decision
• any date up to 28 days after the date of application

Thanks CULLINAN. Also since my visa was issued on 26/11/2015 for 5 years, do i need to provide any proof of absence during these 5 years.
Is there a list of documents for Set O PBS dependents?

Thanks

You need last 2 years cohabitation documents from date of application. The checklist will tell you about the documents but main are, LIUK, English Test/UK Degree, Cohabitation documents, Passport, BRP.
No maintenance needed.
Absences only for any leave granted after 11th Jan 2018.

I filled the Set O form for Tier 2 dependent and the document checklist says my spouse who is on ILR needs to sign the declaration. Is this correct?

Also for the question "Have you previously lived in a country outside the UK including your country of birth?"
I came to UK first in Jan 2011 and then returned back in July 2011. Came to UK again in Feb 2012 for 2 month and then in June 2012 till date. So what should i answer for this question?

Thanks
