ILR Vignette to BRP Card: Citizenship Eligibility Month

Hi,

I received ILR in 2009. The ILR was stamped on my passport(Vignette). After I got ILR, I lived outside the UK and use to visit UK once in every two years just to keep my ILR active. This continued up-to 2015. From September 2015, I have permanently settled in the UK.

In 2019, my passport got expired and I was required to transfer the ILR vignette to BRP card for work purpose.Received my BRP Card on November,2019.

I'm eligible to apply for British citizenship this year as I'm completing five year of continuous residence but not sure which month to consider for eligibility ? As the BRP was received in Nov 2019, do I become eligible only on Nov 2020 as I will be completing be 12 months of new 'BRP' then or as I'm on ILR status from 2009, Can I apply on the day I complete 5 year residence in the UK, which is Sept.

As your ILR vignette is dated from 2009, your ILR status dates from that time. Your BRP is only the latest document that proves your ILR status.

You should be able to apply for naturalisation any date from September 2020 onwards, provided you were physically present in the UK at the start of the five year period immediately preceding the date of application.

You would want to include proof in your application of your ILR status since 2009, so include your ILR vignette from 2009 in the application form submission as well.
