Varying Tier 2 extension application to ILR

Varying Tier 2 extension application to ILR

Hi
My wife’s immigration details (Tier 2 dependent- 5 year route) as follows
Visa start date : 01.07.2015
Date of arrival to UK : 12.07.2015
Recent tier 2 visa : 29.03.2020 (expired)
Tier 2 visa extension applied : 15.03.2020
Biometric appointment : 22.06.2020 (rescheduled due to Covid)
Life in the UK test : 03.07.2020 (to be attended)
I think she is eligible to apply for ILR from 15.06.2020. Is it OK to vary her application immediately after 15th June and include the Life in the UK test results later, i.e. before attending biometric appointment for ILR? Please advise me. Thank you very much.

Hi

Update:

We managed to vary her Tier 2 application with ILR, but it was not straightforward, thanks to my over- smartness. Our experience as follows

Initially, applied for Tier 2 dependent extension in March and her biometric appointment was postponed due to Covid19. In the meantime, became eligible for ILR. So, submitted ILR application in June. For ILR biometrics, was chosen for biometric reuse through IDV app. But, gave in-person biometrics at Sopra Steria centre for Tier 2 application (BIG MISTAKE) and uploaded a cover letter to caseworker requesting to consider this biometric for ILR application as she was already in biometric reuse category, to save time, to expedite the process. But they overlooked the request and granted Tier 2 extension even though there were two outstanding applications at the same time!!! Then contacted HO through their complaints procedure, and they agreed to withdraw the Tier 2 visa, process the ILR application and to refund the Tier 2 application fee + IHS fee. Eventually, gave ILR biometrics through the IDV app and got approval after escalating the case with HO. Timeline as follows

Application Type: Tier 2 dependent extension (2.5 months short for ILR)
Date application sent: 15/03/2020
Type of application: Standard application
Payment debited:
Appointment booked for bio and doc upload: 06.08.2020 (delay due to Covid19)
Decision letter/Email: 09.08.2020 (HO agreed to withdraw this decision)

Applied for ILR Route: Set (O)
Date application sent: 16/06/2020
Type of application: Standard application (priority is suspended)
Payment debited:
Biometric through the IDV app: 28/08/2020
Decision letter/Email: 09/09/2020

Immigration health surcharge on 23.09.2020.
