Are able to apply 60 months in UK - 28days, counted from the date of entry into UK.rmz27 wrote: ↑Fri Oct 02, 2020 9:43 amHi guys im applying for my wifes ILR in 2021, she was granted a spouse visa and came to UK on 13th April 2016 and her BRP was issued on the following dates.
BRP Leave to Enter - 04/05/2016
Expiry - 07/01/2019
We then applied for FLR and that was also granted and expires 15/08/2021 ive forgotten the start date for it.
Could somebody help me work out when I can apply for the ILR?
Would appreciate it if somebody could reply back.
I was told by a solicitor not to start counting from the date the person comes to the uk but only apply 28 days before the expiry of the second BRPrmz27 wrote: ↑Fri Oct 02, 2020 9:43 amHi guys im applying for my wifes ILR in 2021, she was granted a spouse visa and came to UK on 13th April 2016 and her BRP was issued on the following dates.

The qualifying period is 60 months, so what will be taken as the start point of 60 months? It appears that solicitor knows not what he is talking about; some solicitors need to come forums like this to improve their knowledge of what they are collecting money from people for.Ismadoum wrote: ↑Fri Oct 02, 2020 1:20 pmI was told by a solicitor not to start counting from the date the person comes to the uk but only apply 28 days before the expiry of the second BRP.rmz27 wrote: ↑Fri Oct 02, 2020 9:43 amHi guys im applying for my wifes ILR in 2021, she was granted a spouse visa and came to UK on 13th April 2016 and her BRP was issued on the following dates.

But you start counting for the 60 months from the moment you become a resident and receive your brp the spouse visa time isn’t counted my husband came in June 2015 and then we got married in August and he received his first BRP in October so he’s due soon to apply For ILR I’m no professional I’m just repeating what she saidAmazonianX wrote: ↑Fri Oct 02, 2020 1:41 pmThe qualifying period is 60 months, so what will be taken as the start point of 60 months? The initial spouse visa + extension/FLR(M) on the standard/ 60 month route qualifies for ILR.Ismadoum wrote: ↑Fri Oct 02, 2020 1:53 pmBut you start counting for the 60 months from the moment you become a resident and receive your brp the spouse visa time isn’t counted my husband came in June 2015 and then we got married in August and he received his first BRP in October so he’s due soon to apply For ILR I’m no professional I’m just repeating what she saidAmazonianX wrote: ↑Fri Oct 02, 2020 1:41 pmThe qualifying period is 60 months, so what will be taken as the start point of 60 months? Thank you CR001, already confused as I went back checking OPs previous 2015 post and timeline and was wondering "what wasted time"?
Her ilr qualifying period starts from the date she ENTERED the UK in a spouse visa. She can apply no sooner than within 28 days before the 5th anniversary of the date she entered the UK, or 13th April 2021 minus 28 days.rmz27 wrote: ↑Sat Oct 03, 2020 1:21 pmThank you for the head up. My wifes spouse visa was valid from 07/04/2016 and she came to UK 13/04/2016
BRP Leave to Enter - 04/05/2016
Expiry - 07/01/2019
BRP Leave to Remain - 18/01/2019
Expiry - 15/08/2021
So from this information will her 5 year anniversary be from when the visa was valid 07/04/2021 or 13/04/2021 when she came to UK and can we apply after this date? Sorry for all the questions its just abit confusing to work out lol!!
Thanks for the information above, Im going to apply for the ILR end of April 2021 once I have my bank statement and wage slip. That should be okay shouldnt it? It wont cause any problems if I do it at that time.CR001 wrote: ↑Sat Oct 03, 2020 1:31 pmHer ilr qualifying period starts from the date she ENTERED the UK in a spouse visa. I have been here on Tier 2 for 2.5years before that. I stupidly assumed that application is completed once I submit documents to the appointment center and my finger prints. As appointment center says that once I show up they will submit my documents. How application can be submitted if I haven't provided documents....
