Asylum seeker get married to British citizen

Asylum seeker get married to British citizen

Hi

asking on behalf of a non english speaking friend,

a friend of my just arrived in UK and claimed asylum, she has been dating a guy from the same country where she is from but the guy holds British citizen, they now have plan to live together and get married if she is allowed to get married while her asylum process still waiting, what is is process and how can she get married as an asylum seeker?

They have to give 28 days notice to an HO approved Registry office of their intent to marry. They need their passports and proof of right to stay in the UK to do this. The Registry office then informs HO of the notice and HO could extend this period to 70 days to investigate and/or interview each of them separately.

They will only be able to marry once HO gives approval for them to marry. This does not mean on the day of marriage that there won't potentially be issues with HO arriving. Simply marrying a British citizen (if HO gives approval) does not make the friends stay in the UK legal.

The process is the same for everyone from abroad. There is no special route or treatment for asylum seekers.

How long has she been dating the British citizen?

HO could well question why she didn't marry in her home country and apply for a spouse visa in the normal way.

She is asylum seeker waiting for her asylum interview
They have dating for 3 months now
Also she doesn’t have her passport

Where is her passport?

How come they want to marry only after 3 months?

Does her British partner work in the UK?

She came on a lorry and destroyed her passport in France in fear of deportation to Iraq by French.

They are dating and in love so the guy understand that to make it easier for both of them to live together and freely do things together is to get married.

The boyfriend does work

If he doesn't work or have substantial savings, he cannot sponsor a spouse visa either. Any visa she tries to apply for based in marriage will fail.

The BF does work, and she is happy to wait for her asylum process it’s actually more the BF who wants to do the marriage so they are Halal go each other (Muslim marriage)

An Islamic marriage performed in the UK is not recognised. They won't be considered as married by ukvi.

The Islamic marriage in the UK is not recognised by the authorities. They are free to do it but it's just a private agreement between 2 people. It has no civil value for immigration or anything else.

For getting married, she needs an ID. Her embassy may help.

The BF needs to earn £18600/year minimum.
