Irish Residency Calculation & 6 week absence

Post by easylad » Tue Oct 06, 2020 10:02 pm

Hello Everyone!
I am planning on applying for naturalisation in the future and plan on staying in Ireland for my one year continuous residence requirement to not cause issues with the 'six week rule'.

However, I do travel quite frequently and wanted to ask a few questions to all of you clever people.

1) Does my residency start on the date of arrival at the airport or my first eligible IRP registration?

2) Are yearly absences calculated based on Jan - Dec or based on yearly duration since arrival?

3) I was away for 100 days this year to spend time with family. I plan on residing +100 days extra before the start of my one year continuous residence. Do I need a significant reason for this absence or is 'spend time with family' sufficient?

& 4) Since I was away for up to 100 days in a given year before my 1 year of continuous residence, does this mean that I need to record absences for ALL 5 years or just the year where the 100+ day absence occurred?

Thanks y'all!

1. Only refugees' reckonable residence starts on the day of arrival. All other applicants' residence start on the day when you have your passport stamped with Stamp 1/3/4.

2. From the date you submit your application. So if your submit your application today 6/10/2020, then your annual period would be 6/10/2020 - 7/10/2019, 6/10/2019 - 7/10/2018 etc.

3. If you intend to wait for an extra 100 days before you submit your application, your reason is sufficient. The overall requirement is that you have 5 years of residence in the last 9 years, which includes the last 365 continuous residence (which means you cannot travel outside for more than 42 days in the last 365 days).

4. Only where you have travelled outside of Ireland for more than 42 days in each of your annual period.
