Earliest date to apply for long term residence ILR (10 year route)

Post by goeln » Mon Oct 12, 2020 10:26 am

Hi,

I came to UK on Tier 2 ICT visa on 30 May 2011 while I received the visa on 16th March 2011. This year Feb, I have changed my visa to Tier 2 dependent (Visa change done in UK). I want to know for for 10 year (long residence) ILR, what is the earliest date i can apply for ILR (28 days before 16th March or 30th May 2021)?

Thanks in advance for sparing time to reply to the query

Thanks
NG

No sooner than within 28 days before the 10th anniversary of the date you ENTERED the UK.

Your visa start is irrelevant.

Thanks for your reply, but as per the the https://www.gov.uk/long-residence/eligibility

Your 10-year qualifying period starts from either:
when you arrived in the UK with a visa
when you were given permission to stay in the UK

Is second condition doesn't stands true in my case?

They may give you permission to stay in the UK after you had entered, perhaps without leave.
You must also have:

been in the UK legally for 10 years (known as your ‘continuous residence’)
kept to the terms of your UK visa
