Moving to UK from EU

Post by safeery2k » Wed Oct 14, 2020 7:35 pm

Hi, My cousin who lives in Germany would like to move to UK. He applied for Pre settled visa but he's been asked for proof of residence in UK. Does that mean he has to first move to UK and then apply for settlement?

I've gone through the requirements and looks like its something which is required https://www.gov.uk/settled-status-eu-ci ... d-to-apply

So my question is are we filling out the right form? How the family will move, they don't don't the germany nationality yet.

Thanks for the help.

On what basis does he believe they qualifies to move to the UK under the EU settled scheme?

Who is the EU citizen (non British) sponsor?

What is their immigration status in Germany?

A German citizen doesn't have to apply before coming to the UK. He can just come over and then apply.

He has to move to the UK before December 31st 2020, and apply before June 30th 2021.
How the family will move, they don't don't the germany nationality yet.
What's the family's nationality? Do they usually require a visa to enter the UK?

The wife needs to apply for a family permit.

There are two options:

Option 1: All the family traveling together to the UK:

1. Wife applies for EEA Family Permit in Pakistan
2. All family travels together to the UK before December 31st 2020
3. All Family apply for Pre-Settled Status before June 30th 2021

Option 2: Husband travelling first, wife travels later
(kids travel with either parent, and apply to the EUSS at the same time as the parent they travelled with):

1. Husband travels to the UK before Dec 31st 2020
2. Husband applies for Pre-Settled status
2. When husband has Pre-Settled Status, wife applies for EUSS Family Permit in Pakistan
3. Wife comes to the UK on EUSS Family Permit
4. Wife applies for Pre-Settled Status before June 30th 2021

Just to clarify: I understand that the wife is also resident in Germany, so she doesn't have to go to Pakistan to apply for a family permit, she can do so from Germany.

You beat me to correct this. :D

Yes, absolutely (what was I thinking?). She does not have to apply in Pakistan, she can apply in Germany or in any country she is able to travel to.
